ST. PAUL, Minnesota (CNN) — Blasting through the Republican convention hall is the 1977 hit "Barracuda" by rock band Heart.

It's a shout-out to Sarah Palin. When she played basketball in high school, the soon-to-be Republican vice presidential nominee earned the nickname "Sarah barracuda" for her fierce competitiveness.

Some of her opponents revived the "Sarah barracuda" nickname after she became mayor of her hometown, Wasilla, in 1996, defeating a three-term incumbent.

UPDATE: Ann and Nancy Wilson of Heart said Thursday night that Universal Music Publishing and Sony BMG have sent a cease and desist notice to the McCain-Palin campaign over their use of 'Barracuda.'

"We have asked the Republican campaign publicly not to use our music. We
hope our wishes will be honored," the group said in a statement that said they "condemn" the use of the song at the Republican convention.

Well, Stevie wonder didn't object to the big O. The republicans knew after the Palin speech, they were given a notice to desist playing it. They still played it the next day. They obviously didn't care.

Breaking news:

After Heart originally protested to their music being used, a compromise was reached at the 11th hour to allow it.

The GOP promised Heart a night they wont forget by setting up "All you can eat Triple Whopper Night" at the St Paul Burger King.

Unfortunately for local patrons, the local BK had to close after the feast as the restaurant was completely wiped out of the popular burgers, all the fries, onion rings and shake mix. The store will open once new supplies arrive.

I can understand them using a song without asking -- kinda falls in the "it is easier to ask for forgiveness than permission" realm. But after you are told to NOT use a song, it becomes a blantant screw you to the artist to continue to use it. The party is saying "get a lawyer, fight us on this" rather than simply honoring the artist's wishes.

It seems McCain’s people just can’t find the right tunes. Considering how liberal most recording artists are, it’s likely this will continue to be a problem for the GOP. Perhaps John should just stick with John Rich’s “Raising McCain.”

It could be democratic thing, but it could simply be a musical licensing thing.

If the repubs had legitimately licensed the song, then Heart would've been able to negotiate compensation for however the republicans wanted to use it.

Performance licensing, commercial licensing. If they wanted to upload the song to their site, Heart could've got royalties from that.

Her speech was seen by millions of people. Even if it was only played for 30 secs, there's a cost for that and Heart could sue to get paid for how many homes it played in.

Sure it could be politics, but it could also simply be about money...

Yeah I remember reading that, too. But that's an after the fact statement. Not ignoring it, but I think if the republicans had requested permission and offered the right amount of money, they'd have signed before you could blink.

Now that it's been played, interest will peak in their song, so they'll prolly benefit from the publicity.

Does it matter? Some artists don't want their music used to "sell" anything. Others only want their music used to sell certain "products."

Either way it is their right. This is no different that someone saying yes or no to a song being used by Doritos.

did some research and this is the truth. not even sure they need to be w/ascap. they were not making any money off the convention and it was not a commercial use, so while heart can express displeasure at their music being used, they can't do a thing about it otherwise.

aka reagan using born in the usa and springstein getting upset. the cool thing to do is ask the artist but it's not required or necessary. heart can get upset and they have but that's about it.

no. that's making a reach on the connection. the most they would have to do is pay for the "performance" of the song, but in a crowd like that you can't measure the TV audiences as individual performances.

i-net radio is trying to do that and biden backs that plan so i don't want biden near laws for that alone.

example. for my radio station, when i play signed music i pay bmi/soundexchange their fee and they dole it out. i hate soundexchange, love bmi but 2 different issues.

what biden and the RIAA/soundexchange wants to do is charge me for *every listener* when i play a song. on FM they just pay for playing the song regardless of how many are listening.

i-net stations want very much to be fair to the artist but the RIAA would just as soon they all went away and have tried several times to make it financially impossible to do it. biden backs the RIAA on this so no, i don't like it.

as long as it's not a commercial use nothing can be done. heart can get upset and the RNA could be nice and stop it but if they don't, nothing heart can do.

no one worry though. i'm only on this topic cause it's near and dear to my heart. i'm still out of the political attack and defense going on.

Also, it is a good idea to actually listen to the lyrics of the song rather than simply focusing on the chorus. Born in the USA is rather critical of the U.S. in points.
