I think I've posted this once before but this just cracks me up every time I see it. This is an old Yugoslavian man and the device being handed to him is a mobile breathalyzer. The Officer's reactions make this whole thing work.

I've always wondered what would happen if... You told the officer that you are not refusing to take the test, however I would like to speak to my attorney first.

They'll take you in on suspicion of DWI. Has never happened to me and it won't, but I've been told that you need to refuse it if you're drunk.

I saw one person here at the county who part of her probation was to have a breathalyzer installed in her car and the car would not start until she blew into the device.

Oh yeah those are very common. If you don't blow while the car is driving it will shut off and the horn and lights will go on and off.
Knew a guy in college who had one installed.

They'll take you in on suspicion of DWI. Has never happened to me and it won't, but I've been told that you need to refuse it if you're drunk.
Of course they'll take you in, but it would give you time. The thing is, if you refuse, your license can be revoked. My thought centers on that idea, I wouldn't be refusing, I would be asking for council before I self incriminate myself.
It's just a thought, especially since I rarely drink.

It's just a thought, especially since I rarely drink.Good question, but I think the cops would consider not blowing into the breathalyzer when prompted as a refusal, even if you didn't say anything.

If anyone is so bad they need to come to that they shouldn't be driving ever again.You're supposed to pull over and blow into it. They give you 30 seconds or so to do it. And the reason for that precaution is so you don't get someone else to blow in it to start the car, then you drive off and leave the sober one behind.

What you do is refuse the breathalyzer, but ask for a blood test. They'll have to take you down to the nearest clinic or hospital and wait for a doctor to become available to take care of you. That'll knock your result down a tiny bit, so it only helps when you're on the fence.

That's not how it works. You have to breath into it BEFORE you start the car and if youdon't, or you fail, the car won't even start.
