A man who had pleaded guilty to DUI manslaughter stemming from a crash near Tampa, Fla., on Christmas Day 2007 now denies causing the crash that killed three of the four people in the vehicle he hit.

McWilliams initially survived the crash but later died. Belniak was sentenced to 12 years in prison, where he remains. The money is to compensate Belniak for medical bills, "pain and suffering," and "loss of capacity for the enjoyment of life," according to the suit.

Suing and winning are two different things.

Trying to sue and then getting *****-slapped by the judge is a different thing too. :laugh2:

judge's just dismiss, they never do much else

not sure if that state has cost penalties

Like the article said, he is already being sued by the other victims and this suit could play a part on how that goes. Judge or jury can't help but be influenced by this thing no matter how much they are not supposed to.
