Dismissal could be approved as early as Tuesday, April 4.

. . One of Sean Taylor 's attorneys said he is preparing a motion to seek a dismissal of the felony assault charges facing the Redskins safety. Richard Sharpstein said plea bargain discussions with Miami prosecutors could continue in the case, which is scheduled to go to trial April 10. Sharpstein said he intends to present the motion before the judge at a prescheduled hearing on Tuesday, while prosecutor Mike Grieco said, "I don't see there being any grounds for a dismissal."

Of course he is going to say this........but I don't see any either.

This is mostly posturing on both sides. Sharpstein has to move for a dismissal, it would be almost negligent for him not to even though he most likely does not believe that he will get it. And what else is Grieco going to say except that he sees no ground for a dismissal. The part about the plea bargain is probably the one shred of truth you will hear out of them. They likely are negotiating a plea bargain; neither side wants to go to court because jury's are unpredictable. A plea bargain makes them both look like winners.

Wow, well done! Probably smartest thing I've heard all night. I argee on 100% of this. I mean, if your the prosecutor, what are you going to do? "Well I guess there is a case for dismissal, but I'd really like to take it to court". And then if your Sharpstein, you gotta take every chance there is to get your client out of legal trouble. So how can we tell how strong the case is? Probably by the plea bargain. If it's something mundane like community service, there's a good chance the case was weak. If it's a jail term, then the case was so-so. If it's YEARS in prison, then it will go to trial (most likely) and we will see it through, right?

ROTFLMAO... yeah, "dismissal could be approved as early as Tuesday"... never mind that the article says no such thing, never mind that the defense is still in PLEA BARGAIN negotiations (suggesting they're not at all confident that they'll win their motion)...
You really are pathetic, son, you're so DESPERATE for Taylor to get off scot-free... you clearly don't care if he's guilty or not, you'd be quite happy to see him skate, just so you can have him on the field come opening day...
Which would be fine, that's what homers like you do, but you take it to extremes, lying about the boys who will be called to testify against Sean, and distorting the facts about that motion to dismiss...
I never really cared that much about all this until you started this BS, now I find myself hoping he'll be convicted, just to stick it to you...

I have been practicing criminal law for 8 years now so for what its worth here are my thoughts.
1. All defense attorneys ask for a dismissal. But except in RARE circumstances, a judge has not authority to dismiss a case- only the DA can.
2. DA's amend charges all the time, it doesn't really mean anything and doesn't mean the case will be continued.
3. If the only witnesses for the State have criminal histories, it will be difficult for the DA to meet his burden of proof, especially since the defendant is a celebrity.
4. More than likely it will be plead out to a misdemeanor of some sorts with probation.
I would be happy in the future to be a sounding board for any member interested in criminal law stuff.

I don't think Taylor will get anything serious but the skins org, who is considerably closer to the legal ordeal and knows tons more about it than I do, seem to be pretty concerned about it since they paid 30 mil (and made him the highest paid S in history) to a very average SS, the same position Taylor plays. One could say that they just wanted to hedge their bets and ensure that they have a good S tandem but Arch isn't a good FS and Taylor isn't a great FS either, both are overwhelmingly SS's. And I don't know who pays 5 mil to a FS no matter who he is. FS's don't make that kind of money. And Expecting them both to play at the same time leaves something to be desired on coverage IMO.
So what I'm saying is that it seems the skins org seem to think Taylor is in a lot of trouble.

Personally, I think he'll get out with no jail time and probably not even any probation. If he gets probation, he may eventually see some jail time for violating probation somehow or another, but I doubt it. I could be wrong as I was surprised to see Martha get any jail time for lying - politicians do it every day, as well as peddle influence and accept bribes.

I searched the Miami Herald archives and can not find a single article with 'Sean Taylor' published before November. This is where I read the things that I claimed.
But think about it. Sean Taylor gets arrested for allegedly pointing a gun at someone. Complete hearsay.
Sean's friend's house gets shot up by the same people that alleged Sean brandished a weapon and they don't get arrested. Bullet holes in a house with shells recovered from two different guns. Sounds like there should be an arrest in this situation if Sean and friends claim they know who shot the weapons.
Believe what you want.

The way I see it, is ST probably pulled a gun on somebody, but the state has a lack of proof, and the case is probably going nowhere. I think ST will be fine, and he will get off with community service and some fines. I do worry however about ST's attitude, bc is he really getting punished? If he walks, then he doesn't learn a lession and he could cause problems in the future. I hope this potential jail time has shocked this kid, and that he will change, but i am not too sure yet. He has alot of talent, he could be the most dominent safety in the NFL for years to come, or the complete opposite, it really lies in his hand. This along with the spitting thing, makes him look terrible in the eyes of the NFL, esp bc he lied to our coaches about spitting. I will be very happy if he gets out of this, but at the same time I am worried he has not yet learned his lesson.

As a reporter who has covered his share of criminal court cases, plea bargains are par for the course. They're either presented before the case starts or at the end of the trial, if the defense attorney feels the prosecutor hasn't sufficiently presented his case.
I wouldn't read too much into this story. In fact, the prosecutor, if he doesn't accept a plea bargain, generally feels he has a strong case.
Having said that, I doubt he serves any time in jail.

You don't know what the full scope of the evidence against Sean is, so that's nothing more than speculation on your part... as others have pointed out, if it was merely the word of a bunch of "felons" (as you characterized them in your ever-biased style) against that of a celebrity, it's rather unlikely that the DA would have tried to take this to court...
It's also likely that he'd have been MUCH easier to deal with in the recently-completed (unsuccessful) plea negotiations, being cognizant of the difficulty of getting a conviction against a celeb even if he has a strong case...
But try as you might to spin all this into good news, the truth is the plea bargain negotiations have broken down, the chance of the judge dismissing the charges are VERY remote, and it looks almost certain that trial will begin as scheduled... logically, this suggests that the prosecutor is a lot more confident about his case than you are... LOL...
Sean's friend's house gets shot up by the same people that alleged Sean brandished a weapon and they don't get arrested. Bullet holes in a house with shells recovered from two different guns. If there was an arrest, there is a publicly available record of it... until you, or anybody, provides evidence of such an arrest, that dog won't hunt...
Believe what you want.
That's obviously what YOU'RE doing-- you're thinking with your heart, not your head... you don't EVEN want to consider what happens if your precious her gets convicted, and it seems you don't really care if he's guilty or not...
Meanwhile, I'm looking at the news that I see in print, and applying common sense, to form my opinions... IOW, I'm operating strictly off the facts that we DO have available, and not casting wild aspersions with no evidence whatsoever to support them...

As much as I would enjoy some of these trolls misery ..... I really hope that kid doesnt go to prison for almost 50 years. hopefully he is innocent.

I doubt he will get 50 years but I bet you anything he gets 1-5 years. Simple fact is there is a lot we don't know at this point. I would tend to lean that someting more severe was done and we just don't know about it. To get 3 counts of 15 years and an additional 1 for something else is a pretty good indication of severity. Originally they were saying there were no shots fired now they say he did.
If he fired at someone and there are witnesses he is %$%^&&.
I hate to see a kid get in trouble but when you look at the character of this guy on and off the field he is getting whats coming to him.
I hope this wakes him up and gets the thug out of him. When he spit on someone that told me enough and to think people compare this guy to Roy.
