I want to point out that I have zero tolerance for people who drive while under the influence. I have lost three good friends in my life in three different DUI related accidents, none of which were their fault.
That said, given the family of the victim is not out screaming for justice/revenge and the fact that he victim was likely heavily intoxicated as well and voluntarily got in the car, it is feasible to consider that this may end with no jail time, but instead a very lengthy probation and suspended license period.
As I said though, I will lose no sleep either way. Too many innocent people lose their lives when others choose to drink and drive.

Pretty much my view as well.
US traffic deaths have gone down from 60,000 forty years ago to around 33,000, but nearly 10,000 involve DUI, several thousands distraction by cell phones. In other words, automakers have reached a plateau on safety - it's time to demand drivers to take responsibility - the thousands killed over this says they have not.
And yes, since Jerry Brown died, I've read at least of one local traffic death: "passenger ejected from vehicle"
Maybe in a few decades there will be automated cars to get around this problem, but that's a long time with no guarantee.
