    It is a lesser included or different charge ....If they can't prove the alcohol content of his blood --they may be able to prove recklessly and carelessly caused the death of..

    He is an idiot:
    1.He was drunk, the passenger wasn't. Why not let him drive?
    2.Is allowed bail. Pisses hot for weed...

    This guy deserves the death penalty. All the opportunity in the world, zero brains.

    You may be charged with more then one offense or lesser included charge ---but not convicted of both( for the same offense). The jury may find him guilty of the manslaughter if the blood alcohol test is thrown out and they can't prove he was drunk.
    They find find guilty of recklessly causing the death of someone.. Usually the lesser included charges will carry a lighter sentence. And it may be setting the stage for a guilty plea to man slaughter
