The NFL and the NFLPA went to court as part of the NFL's appeal. Here's some highlights:
I'm surprised that some members in the media are surprised by this. Regardless if you think Brady cheated or not (I think it's clear as day that he did), Goodell's suspension was within the guidelines of the CBA agreement. Neither the NFL owners or the NFLPA thought thru the punishment guidelines very well because the appeals go thru Goodell.
Judge Berman's authority would be if the NFL wasn't within the punishment guidelines. For example, if Goodell gave Brady a 5-game suspension instead of a 4-game suspension.
If the Patriots lose, I suspect they'll appeal and sue the NFL. But, we'll see.
