Ezekiel Elliott is in New York ready for a fight.
The Cowboys running back is appealing his six-game domestic violence suspension from the NFL and a hearing is set for Tuesday morning. However, Elliott won’t be alone.
The NFL Players Association has once again called upon attorney Jeffrey Kessler. If that name sounds familiar it’s because Kessler represented New England Patriots quarterback Tom Brady in Deflategate. Kessler was also involved in the last antitrust case filed against the league.
NFL commissioner Roger Goodell chose former league executive Harold Henderson to hear the case, which was something Elliott’s representatives asked not to do. The union argues that Henderson is not a neutral party in the situation.
Henderson refused a request from Elliott’s camp to make his accuser, Tiffany Thompson, available to appear for cross-examination at the hearing and refused to force the league to present interview notes and transcripts gathered when interviewing the accuser.
If the suspension is upheld, Kessler could file a lawsuit against the NFL, which could allow Elliott to possibly play. If the fight reaches federal court, the suspension could also potentially be delayed into the 2018 season.
The Cowboys will open the regular season on Sept. 10 in Arlington against the New York Giants on NBC Sunday Night Football. Kick-off is scheduled for 7:30 p.m.
