Look at the angle of the camera. You might be able to argue that his hand is CLOSE to the ball, but even that is debatable at best.

Nope -- he almost certainly would NOT get flagged. Ever. Lots of nose tackles line up with their helmet near or over the ball and never get called for it. Watch any team that slants a tackle over the center -- they're over the ball a lot. Casey Hampton and Michael Myers (Denver) are prime examples.
Here are just a few examples from games I had on my Tivo when defensive players have lined up over the ball or much closer to the ball than Ware was after he moved, and none of them were penalized --
The Giants' LDT, William Joseph, moves before the ball is snapped, an his helmet is past the 50 --v
The Giants' RDT, Barry Cofield, lines up with the top of his helmet touching the 30 --v
Michael Strahan (LDE) lines up with his helmet across the 29 --V
Here's when Bledsoe was sacked for a safety. The nose tackle and left end are lined up with their helmets at the 1 --V

The Chargers-Seahawks game from Sunday had both defenses lined up right on the ball or over the ball almost all game, and they weren't penalized for it.

Ware was NOT offsides. He got flagged because he began moving before the ball was snapped and whipped the tackle, so the ref assumed he must have come across the line early. But he didn't, and he shouldn't have been flagged.
