Can you be arrested and/or evicted in this situation?

Here is a hypothetical situation.

You have a person who is in financial trouble and knows he will not be able to pay his mortgage in the next couple of months.

He decides to get a cheap apartment before his credit takes a hit because he is going to walk away from his mortgage.

The apartment complex asks him about the mortgage on his Credit Report and he tells them that he is moving into the apartment so he can rent out the house (which is an obvious lie).

Can he be evicted and/or arrested if the Apartment Complex finds out he lied? Also, would the Apartment Complex even verify that he is renting the property?

I'm confused as to why having defaulted on a mortgage would disqualify someone from being a renter?

If that were true, we'd have a lot more homeless people.

Some Apartment Complexes, like the one I live in will not rent to those who have a Foreclosure.

That or they will ask for insanely high deposits.

Just say your intention is to sell the house. You cannot be arrested, but to be evicting there has to be reasonable cause to do so and it's a difficult thing to make happen.

You can't be arrested for lying about the reason you are renting an apartment.

They can't evict you from the apartment unless you break the terms of the lease, and lying about why you got the place probably isn't in there.

If you don't yet have a foreclusure, then they can't treat you like you do.

Yeah, this isn't like an employer firing you after discovering a lie on your resume. As long as you're paying the rent on time, the apt complex probably won't give a damn.

To clarify.

I don't close until Thursday and in no way am I in danger of foreclosing.

I will be a first time homeowner, so I am having to think about things I never thought about before.

God forbid, if I ever got into trouble in the future, like the guy that is selling me his house, I just wanted to know what some of my options would be.

You can tell them that you planed on renting it out but didn't find anyone.

Just stay in the house and default on your mortgage. The government will hook you up and the rest of society will cover the cost.:bang2:
