I could be wrong but I think you can refuse a breathalyzer, but you have to take some other sobriety test. Then I'd you refuse that you go to jail.

As far as I knew if you refused a breathalyzer it was jail and automatic license suspension. But they can't prove crap is u pass a field sobriety test and don't blow.

We better hope he can play well enough to push Moore in camp and preseason or Moore isn't likely to get much better. He got the backup job by default and that's never good so Dak needs to provide some competition. I think we're making a big mistake entering camp without a veteran backup QB. We need to strongly consider signing Foles to a team friendly contract if possible or we could be scrambling for a veteran during the season like last year if Romo goes down again and we find out the backup QBs we have can't play.

I honestly see it as a win/win. If Romo gets hurt......we know its probably time to move on from him. If he doesn't...we'll have a successful season. Either way either we will be in the playoffs or have a solid draft pick. Nick Foles has proven he can't play in this league unless he has Chip Kelly.

Risen has the benefit of knowing for sure if a player will be good before ever seeing him play a snap, so he's got a big advantage there.

Didn't Dak publicly apologize for driving in his condition after he was pulled over? I'm glad he's avoiding the headache here, but he might have benefited from an technicality.

EDIT. Here's Dak's statement, btw, at the time of the incident:

"I want to make a statement, and first take complete responsibility for my actions," Prescott told Ian Rapoport of NFL Network on Sunday. "I'm very remorseful for my misjudgment. I want to apologize to my true supporters, my family, Mississippi State University, the NFL and the kids who look up to me. I won't ask for forgiveness; however, I'll show the true man I am and exhibit my character through my actions and behavior going forward."

We'll probably never know for sure whether Dak was intoxicated or not and if so, to what extent. But the judge examined the evidence carefully and eventually found him not guilty after watching film and evaluating the evidence at hand. That's plenty good enough for me to afford him the benefit of the doubt. Seeing as how it was legally his first drinking slipup, I think there's quite possibly a good chance it won't be repeated.

Played well in the senior bowl and we got him in the 4th round, maybe would have been an earlier pick if he wasn't arrested. I hope Romo takes him under his wings and teaches him to be a Jedi.

Moore isn't going to get any better no matter who pushes him. He has physical limitations.

Despite Moore's physical limitations he has only 2 career starts and is still a developing player which is one reason he was brought in and is still on the team. Regardless the physical limitations a player has they can still improve with experience and competition. Competition puts some pressure on a player and you want to see how they respond to it. If Moore can eliminate some of the turnovers he committed last season that alone will improve him. Whether he can improve enough to help us win some games if Romo goes down remains to be seen. Hopefully we don't have to find out this season.

Judges don't give breaks on DWIs any more.....if he was found Not Guilty there wasn't much evidence
