Bingo!!! You're exactly right. I'm a courier for FedEx and have been for 22yrs and I come acroos this type of thing all the time and have had close calls. Sober or not, it's difficult to see a person jaywalking in a not so well lit area, especially if they're wearing dark clothing. It's extremely possible for a accident to occur.
Didn't Stallworth say he flashed his lights at the guy? Obviously he saw him.

Given the situation, he belongs in jail.

Because he was driving drunk, yes, but not because he hit him. That jaywalker played just as important roll as DS did.

Yes and he tried to avoid him as well. Accidents happen!! His problem was that he was drinking. Just cause you see him and flash your kights doen't mean you can avoid him..

Of course not. But it's enough for the Celebrities Are Being Unfairly Treated Brigade to cry about it.

Yes he was jay walking, and holds some blame in his own death, but if the moron driving the car hadn't been drunk and speeding he could have avoided hitting him anyway.

Someone else being a moron doesn't excuse Stalworth from willingly drinking, and then driving, and adding speeding on top of that. He deserves whatever punishments he gets for that.
He also had marijuana in his system.

That doesn't mean he smoked it that nite. Weed stays in your system for a long time..

Well I certainly don't know all the facts but I thought this happened close to a crosswalk, I didn't realize this was the middle of a highway where no one would ever cross.

Doesn't mean he didn't either.

I actually saw video of the crime scene. Not sure on what site.

The man's death is very unfortnate, but it's not as cut and dry as people want to make it, which is probably why he got the sentence he got.

Yep, very dangerous move on the jaywalkers part. Sober or not, his chances weren't very good especially in a dark area.. It wasn't a smart move at all....

It wasn't that dark, but it does show that guy walked into the street from a blind spot on a busy street.

Pretty much the issue comes down to people not either not being able to process multiple things at once or trying to be morally superior (e.g., "I would never drive drunk"). The simpler thinkers say "he was drunk - it is his fault" but completely fail to recognize that other factors play into the blame for the accident. Did being drunk increase the likelihood that there would be an accident? Of course, and that is why he is being punished. Was being drunk the ONLY cause of the accident? Of course not... which is why he isn't still in jail.

Shouldn't be allowed to play ever..

He killed someone.

I grudgingly agree.
The same should apply to Vick, despite all the lamentations by his apologist, Tony Dungy.

Stallworth loses, the victim certainly lost and his fans and team lose.
No winners. It is sad.
But back to the real world. I hope this makes some think twice before drinking and driving. Taking a human life is the worst thing you can do.
And being suspended for a year is an adminstrative slap on the wrist but, still, it is the right thing to do in this case.

If Stallworth had been sober when the accident occured, he wouldn't have been suspended by the league.

I couldn't agree more. Again, I'm a cat who drives for a living and have had many close calls myself in dark areas with people crossing the road in the middle of it. It's extremely dangerous!!!

I agree. His problem is that he was drinking and thats where the punishment comes in.

Very well stated...

So he deserved to die for jaywalking?

It's not a question of 'deserve'. He put himself in a ridiculously dangerous situation and he got killed.

I don't understand the anger at Stallworth. He wasn't particularly hammered, and by all accounts, he was devastated at having killed someone. This could have happened to any one of us who was changing a radio station or looking at a cell phone at the wrong time. It's not even clear alcohol had anything to do with it.

I know I've personally been behind the wheel after a couple of drinks many times. Had someone jumped a fence and jaywalked the freeway in front of me any of those times, I'd be in the same boat Donte's in, whether or not my driving had actually been compromised at all.

Stallworth was legally drunk, it doesn't matter whether he was "hammered" or not. He had just received a check for $5 mil, I imagine he could have afforded a cab.

A "couple of drinks" will not put you over the legal limit and thus you would not be in the same boat as Stallworth. A few more than that, and I really have zero sympathy for you, to be honest.
