Fifth Circuit ruling possible in Elliott case on Monday

The NFL the NFL Players Association head to a federal appeals court on Monday regarding the effort by the league either to stay the injunction that blocks the Ezekiel Elliott suspension or to dismiss entirely the Texas lawsuit that led to the injunction. Per an NFL source, the league believes it’s possible that the court will rule from the bench.

If the U.S. Court of Appeals for the Fifth Circuit issues a decision during the hearing that dismisses the case for lack of subject matter jurisdiction, the federal lawsuit filed by the NFL in federal court in Manhattan will most likely proceed immediately. The league anticipates that Elliott and the NFLPA will then try to get the same injunction from the New York court that was secured in Texas. Absent that injunction (and the league believes its ultimate success in the Tom Brady litigation could block that injunction), the suspension would begin as soon as Week Five.

While it’s impossible to know what any court will do in any given case, the league is pleased with the fact that the appeals court scheduled oral argument on the issue, and that the court sought separate written argument on the question of whether jurisdiction exists in the Texas federal court. Those steps are interpreted as a sign that the court is taking seriously the question of whether the case should be dismissed.

I'm not sure why this would be a sign of anything positive for the NFL. The legal system is just providing the opportunity that it should being one of the finest justice systems in the world, unlike the NFL's kangaroo court which already made its decision regarding Elliot despite any (stronger) evidence to the contrary and just went through the motions of a "fair process".

I think Zeke is in for a 6 game suspension this season. And I'm not happy about that at all. But, I think it's decidedly better than one starting next season.

Not sure why the NFLPA would have had to wait until Henderson gave his ultimate ruling to file in court.

The hearing became unfair to Zeke the moment Henderson ruled that the accuser and Goodell didn't have to testify and that he was not going to give the interview notes to the defense. That was in the first few hours of the 3 day hearing. Anything after was nothing more than a show trial and was totally unfair to Zeke.

The moment Henderson made those unfair rulings, the entire hear thereafter was unfair. So to me, the NFLPA could file right then and there, at the beginning. No need to wait for Henderson final ruling, when everyone knew it was a fait accompli.

What other possible reason could you have to file a suit against the plaintiff immediately after an arbitration ruling other than securing venue of choice?? (Brady case)

So then, what other possible course of action could the NFLPA have taken to ensure they weren't blindsided by this unfair process? Bug Henderson's office so that when he started to give the ruling the NFLPA lawyers would be tipped off? Hire a private investigator to follow Henderson around, to spy on him so that he could tip off the NFLPA to an imminent ruling?

No, those are illegal options (obviously). The NFLPA had no other recourse but to file a suit BEFORE the ruling because unlike the NFL they had no idea when the ruling was going to come
