GRESHAM, Ore. -- The driver of a car that hit three Oregon high school students on Jan. 15 was allegedly recording a video with her cell phone at the time of the accident, and did not have her hands on the wheel, reports The Oregonian.

Elizabeth Rachel Dove, 23, of Gresham, Ore., was arrested on March 4. She is charged with three counts of assault, five counts of reckless endangerment and one count of reckless driving.

The Oregonian reports that in a 19-second long clip on Dove's cellphone recorded just before the crash, the device is in her left hand and she can be seen gesturing at her young son with her right hand.

Is is news because she had a cell phone? What if it was burger, or drink, is it news worthy then. This campaign against distracted driving (cell phones) is absurd a study showed the stigma of distracted driving, again cellphones, is one of the low hanging fruit variety. Studies have shown accidents with distractions cellphones are pretty far down the list, near the top eating, drinking, radio and kids in the back seat.

always someone trying to make excuses for stupidity. And those studies you talk about have been widely panned and frankly look very suspicious. Considering the number of people I see all the time with a cellphone glued to their ears while driving.

the worst drivers on the road distraction-wise are:

1) People stuffing their faces
2) Women putting on makeup

Ive had more encounters with the above 2 than cell phone drivers

More and more studies are showing the probability of getting in wreck while texting ( or worse, filming) is as high (or higher) statistically than if you were drunk.

The penalties should be very harsh.

She was shooting a video of her baby in the front seat and dropped the phone, which prompted her to take both hands off and end the video just 1.42 seconds before hitting the teens. I'm not sure how you can relate that to eating or drinking or doing much of anything else. Show me the study that proves the act of eating or tuning the radio is worse than what she did.

I've encountered both of those types of drivers. They are bad, but not as bad as the ones distracted by cell phones that I've come across. I know it is just anecdotal evidence, but this has been my experiences and a I drive quite a bit for work.

I am not saying distracted driving is not bad or that this person should be given a pass. If she had spilled a drink in her lap would there have been the same scorn.

Handsfree technology cars are considered even far more of hazard than handsfree headsets or using a phone non hands free

If she had spilled a drink in her lap it would simply have been an accident. Yes, the act of drinking is a distraction, but it's on an entirely different level than actively shooting a video. Had she set up an espresso machine in her car and had an accident while steaming the milk for her latte then I'd say we were talking about the same level of distraction. From the court documents:

Dove sent a flurry of text messages in the minutes before the crash and then used the cellphone to record a 19-second video of her son while he was in the car’s backseat.

“(Dove) is holding the phone with her left hand and was making gestures at times with her right hand,” Annamarie Shoen, a Multnomah County deputy district attorney, wrote in the court document.

Then there is a 6-second video of the phone bouncing on the front passenger seat.

“Dove is panicked and there is a child crying in the background,” Shoen wrote.

A police officer was able to determine that Dove hit the teenagers 1.42 seconds after the video ended, the court document said.

And this moron was shooting the video with her infant child in the car. That's the worst thing about this entire article IMO. Not that she was putting the baby's life at risk, although that's terrible, but the fact that this ******* felt compelled to pass her genes on to another generation. You just know that kid got the short straw in the intellectual lottery.

Ya...I used to drive all over Kentucky when I worked for Geek Squad...the absolute worst ever was a dude in a kia or hyundai trying to unwrap a snickers in the fast lane while swerving and braking all over the place.

and it depends on the cell phone driver...if its buried in their lap and trying to read it, ya, they usually blow. but the ones that hold it up to keep cars and the road in their view, usually never see them have any issues.

the absolute worst thing I have found that I can do in my car that makes me drive unsafe is.....entering an address in the gps on the dash. Didnt think anything of it at the time, but leaning forward, getting out of your driving position, leaned almost against the steering wheel trying to hit small keys while hitting bumps in the road...its terribly unsafe. I was all over the road and had no ability to pay attention to anything around me.

that being said, I text and drive often...never had an issue, though i dont bury my phone in my lap either.

Reminds me of that Harvey Danger song:
Been around the world and found that only stupid people are breeding
the cretins cloning and feeding
And I don't even own a TV

The Cellphone is outpacing these things where I live... if someone is swerving, or driving slow, or stalled at the light... It's pretty much a given they're on their cell phone.

The obsession of people and their phones...
I fully expect the next generation to never look up while walking...

I think it all just goes under careless driving.... you can be just as careless eating, or applying makeup.
anything that does not allow you to concentrate on the road is equally dangerous.
