After lawyers for Tom Brady filed a scathing legal brief slamming the NFL and Commissioner Roger Goodell for running a “smear campaign” against the star New England Patriots quarterback and publishing “propaganda” against him in the league’s 20-page decision upholding Brady’s four-game “Deflategate” suspension, the NFL hit back with a document that contained a startling and incendiary claim that may reveal what lies at the heart of the now seven-month conflict.

As reported by Mike Florio of the NBC Pro Football Talk site, the NFL is now claiming that it holds the authority not only to uphold the bizarre four-game ban on Brady, but also to actually make the punishment even more severe, if Goodell so chooses.

Citing the provision of the league’s collective bargaining agreement with the NFL Players Association, stating that in the case of fines for “unsportsmanlike conduct on the playing field” the league may not increase a punishment once it has been set, the NFL’s brief filed Friday, August 14, says that the restriction does not apply to Goodell.

“The CBA imposes no such limitation on the Commissioner’s decision in appeals such as this one involving discipline imposed under Article 46, Section 1(a) for conduct detrimental to the integrity of the game,” NFL attorneys wrote in the document filed in federal court.

That article is extremely misleading either because the writer doesn't know what they are talking about or because they simply wanted to mislead readers who don't go any further than reading headlines and maybe the first paragraph.

What the NFL claimed in their most recent filing (from Friday the 14th) is that Goodell could have increased the suspension in his role as arbitrator of the Brady appeal. Ignoring the fact that not a single lawyer in the country thinks they would have gotten away with that (see the Ray Rice case as an example of how well that worked for them), their own filing admits that the time to increase the suspension has come and gone.

Sorry, but it isn't something that could still potentially happen.

That's how I would handle this situation. Since we are talking 'law', I could see a prosecutor telling the defendant to admit to wrongdoing or seeing more jail time. Hope that is how it is handled but I highly doubt the penalty will be rightfully increased

My statement in this particular thread wasn't in defense of anything.

I'm just correcting the flaw in the article because people in here seem to think the writer of that "inquisitr.com" article knows what he was talking about when he really has no clue.

And you are saying you do? Even tho you've been wrong about just about everything related to the Cheatriots as they've tried to cover up and deny their deflating cheating ways?

I would be for that. Not because it's the pats or Brady. It's because that "above the law" mentality needs to humbled. Increasing suspension would do that. It would do that.

Furthermore, it would show that you should quit while you are ahead. Don't be defiant when you know you are wrong.... Caught for cheating.... Again!

Dude, relax. The "inquisitr.com" article is mistaken, so I corrected the mistake because I thought people in here would want to know how things really stand and what the NFL really said in footnote 4.

Yes, that is exactly what I am saying. I've made bad predictions, but I've never made inaccurate statements of fact of things that have already happened. So yes, it is clear I have a better understanding of the NFL's August 14 filing than the writer of that "inquisitor.com" article.

Right now the NFL is married to their 4-game suspension. Remember, they are the ones that filed the motion to confirm. You can't announce a punishment, file a motion to confirm your own punishment, then change it later on. (Ironically, if they lose in court then they can change it, but it is not even remotely realistic that they lose in court and come back with an even more severe punishment)

I have no idea what people do or don't appreciate. I know if I read and believed an article that contained a factual error, I would definitely appreciate someone correcting the errors in the article so that I was no longer believing a false assertion.

As you pointed out the error... I simply pointed out that you would make sure to point out said error.

We are both making sure things are understood because the cowboy fans on this cowboy board would want to know about the error... Right quick.
