If the NFL upholds the appeal Hardy will sue in Federal Court like Peterson did. He will probably win like Peterson did and the League will appeal like they did after the Peterson case.

In other words, this can drag on for a long time. The main question is.....will he be able to play any games while sifting through the courts?

The NFL will appeal any Federal Court ruling and keeping a player on the Commissioner's Exempt List gives them cover because they are still getting paid.

Hardy may have screwed himself with his contract structure.

Getting an injunction from the Courts may be the final recourse and they have been reluctant in the past to get involved when CBAs are in place.

There is always the chance that Peterson's appeal is heard first and establishes the law of the land. The NFLPA has been told their Contempt of Court hearing will be held on Aug 13th.

They didnt appeal Dotys Peterson ruling.

Yes they did.

That is why the NFLPA filed the contempt of court motion. The League says they don't have to act on Doty's ruling because they are appealing it. The Eighth Circuit has yet to set a date for the appeal.

That's probably true when they are challenging the fact that theyre being punished at all, but I wouldn't expect Hardy to have challenged 2-4 games.

Honestly not trying to argue with you, but why wouldn't he have challenged it when the case was dropped?

Because his lawyer would explain to him that the level of stink caused by his incident demands some sort of monetary punishment, no way the NFL or media lets it slide without some kind of hit to his pocketbook.

I think it is a big enough difference between 2 and 4 games(1.2m dollars) to fight it.

He wouldn't have much PR support but that is pretty insignificant at this point.

Hardy & The NFLPA would most certainly ask for a temporary injunction while the case is being litigated. He will most likely be playing until a final resolution is reached.

I think it has to do with how much Peterson will be fined. The suspension will be ruled to be 2-6 games and at 750k a game it could mean millions.

Setting precedence is also a factor and Hardy's case will be affected by the ruling, even though that will be the last case that could be covered by the old rules.

The NFL knows if they run out the clock they win even if they eventually lose and they can maintain they came down hard on Peterson and Hardy after looking soft in the Rice case. The ironic thing is that they were following their own rules in the Rice case initially.

They had to start breaking their own rules and began making it up on the fly to try and quiet the public outcry. If they had just took the initial hit and gave them all 3 games, this all would've been over with last November.

actually I think you are full of crap. What has rust to do with as regards rushing the passer? This is not a QB.

There is also a difference between practicing against teammates who want to test you, but not hurt you... and playing against guys who realize that they would gain a lot of fans if they took your head off.

But how is he playing? And why did the nflpa file contempt? Hes playing. The nfl appealed Doty decision, if they was to win which they won't but if they did Peterson can still be suspended?

Peterson WAS ALREADY suspended last November. He was to miss the last 6 games without pay. He appealed and the length of the suspension was in question so the money wasn't taken and he remained on the Commissioner's Exempt list.

Peterson won the appeal and Henderson's award was vacated. That meant the League had to make a new ruling, the original 6 game suspension would not work. They appealed that ruling to Eighth Circuit and DID NOT follow Doty's order. They said the appeal has to be heard first.

In the mean time Peterson was reinstated from his indefinite suspension and removed from the Commissioners Exempt List. He already served a 2-6 game suspension so the reinstatement was needed whether they won or lost the appeal. The appeal will only decide how many game checks to take from Peterson.

Looks like another week gone by with no decision. Delay, delay, delay.

I fear the league is trying to create a waiting game that will make Hardy's appeal more pointless. If he has to wait as long as Peterson did, he might as well accept the 10 games.
