Tony Stewart not charged by grand jury in death of Kevin Ward Jr.

Tony Stewart will not be charged by an Ontario County (N.Y.) Grand Jury in the death of Kevin Ward Jr.

The grand jury determined Wednesday that there was no evidence of a criminal act. The case was passed on to the grand jury by Ontario County District Attorney Michael Tantillo last week.

Tantillo said "two dozen" people were interviewed in the case and revealed that toxicology reports determined that Ward had marijuana in his system.

"There is toxicology evidence in the case related to Kevin Ward, that actually indicated at the time of operation that he was under the influence of marijuana," Tantillo said. "There was no toxicology work performed on Tony Stewart, however a certified drug recognition expert had interviewed him on the night of the collision and determined that he found no basis to observe any alcohol consumption or impairment by drugs."

When asked about Ward's toxicology reports, Tantillo said that the amount in his system was "enough to impair judgment."

Wow. Feel bad for all the crap Tony took. This was a young arrogant kid who felt he could compete under the influence. Far from professional. Unfortunately it cost him his life. And Tony was just in an unlucky position.
 
The fact that we now know the kid was high speaks to why he did such a stupid thing getting out of his car to begin with. I too am glad Tony can now get on with his life.

Apparently the family is still pissed (even more with the news) and will pursue Tony even harder. I figured they'd bite their tongue after the news. I guess they're as bold as their son.
 
Interesting news for sure. I'm wondering if all of those who claimed they could see Stewart intentionally drive towards Ward will now see this in a different light?

I'm no Stewart fan but I'm happy that this thing is finally coming to an end. This was very, very bad for Racing.

I happen to know someone who knew the kids father. He was also a race car driver here locally and apparently, he was a bigger "hothead" than his kid. At any rate, even if they do attempt a lawsuit, I doubt it will go too far In light of this latest news.
 
Let's do the math here. A driver gets out of his car in a night race, wearing black, walks two thirds down racetrack avoiding cars as they pass, high on marijuana and he is going to sue someone for being hit? Good luck.
 
I've never seen marijuana possess anybody to get out of their car and to step into traffic. And being 'high' on marijuana and having marijuana in your system are 2 different things.

It doesn't help Ward's case any. But, I think it really comes down to the video and the angle it was shot at that you can't be convinced beyond a reasonable doubt that Stewart either tried to hit Ward or tried to scare him and accidentally ended up killing him.

The pot is just to keep this from going forward.
Had nothing to do with what he did,

He thought he would go after tony.
Tony tried to scare him.

Car out of control. Very unfortunate.

Tony should have gotten out of car and whipped his butt, using the car was a mistake obviously. It wasn't his intent to kill him. But poor decisions on both guys caused this. If we are looking at this honestly.

They've already confirmed he had enough pot in him that would affect his judgement.
 
To be honest, if I were the other drivers that were driving that night, I would be a little pissed to find out that Kevin Ward was high driving on the same track as they were at the same time. To me, that's a big ***.

I've seen people get sued for less. Unfortunately, Tony will probably settle with them.

What's really clear, coming from someone who grew up at dirt tracks, is that you don't know much about racing.

There was no story here other than a hot head kid losing his temper and killing himself.
 
I will never be convinced that Tony even knew he had wrecked the kid, much less had a reason to try to scare him or, especially, run him down on purpose.

At any rate, Tony will probably pay them before it ever goes to court.

Doubt any of the haters will even look at the evidence or read the full report. They made up their mind off of a cell phone video and a NASCAR persona. Logic does not enter the equation.
