Quick question....I purchased a Driver head on ebay with the following description.

Item specifics
Condition:
New: A brand-new, unused, unopened, undamaged item in its original packaging

IT'S BRAND NEW AND JUST HAS SOME SCUFFS FROM BEING MOVED AROUND AND SOME BALL MARKS ON THE FACE FROM BEING HIT IN THE SHOP. THIS IS A GREAT CLUB FOR THE MONEY!


When it showed up, there were Sky Marks on the top, nicks and scratches all over the club, with paint missing...obvious wear on bottom and face, bottom two grooves on the face still had dirt in them.

I don't want to jack with returning it....which he said that I could do....but I do think that I'm due some credit for blatant lying about the condition. I was expecting 9/10....it's about 7/10. My question is this....what is the possible ramifications of writing a bad review on someone? My brother told me that they get the chance to say WHATEVER they want back about you....true or not true....and then you get ZERO chance to refute what they say. Is this true? What do y'all think that I should do? Thank you in advance!

i'd just return it for a refund or open a case with ebay...alerting them to what happened.
in that scenario...you're communicating directly with ebay and not the seller.
i don't get into a back and forth.
i think you should open a case...they described the item as brand new...unopened and that was not the case.
plus they played games with the item description...first calling it brand new...unopened...then talking about lite scuffs.
i'd report'm.

as for bad reviews...it turns into a he said/she said.
i don't read the reviews...i do however look at their rating or score and how many positives vs negatives.
but yes...there are many sellers who "snap-back" in the reviews.
thats why i'd either...
a. live with it and learn from the mistake.
b. send it back for a refund.
c. initiate a case with ebay...they will review it and make a ruling...probably in your favor.
they could issue you a refund and you keep the club...or issue you a refund and you return it.
i'd go with c.

Contact the seller first. State what was wrong and ask them how they are going to resolve this issue. Give the seller a chance first. EBay will ask if you have contacted the seller. If this gets no where (shouldn't take more than a day to see where this is going) tell the seller you are going to open a case against them on eBay. Typically that lights a fire under them.

Flat out lying, should not be tolerated.

You have two choices. Send it back or keep it. If it's in good enough condition to keep, writing a review will get you nothing.

I am no longer interested in getting any compensation....I am over that...but I would like to initiate a case so ebay is aware of what went on....anyone know how to initiate a case? I am not very ebay or computer savvy!!!

I have rarely used Ebay, but I would guess that even if you open a "case" of some kind against the seller, the moment the seller tells Ebay they offered to refund the purchase and you declined, the case will be closed.

I get what you are wanting .. you want the item, but just want a discount because you believe it to be worth less than what you paid due to the condition of the item being worse than the seller stated.

Assuming this was not an honest mistake by the seller, I think it is dodgy way for sellers to do business. However, you do have a choice of a refund while having no right to a discount.

The seller has two options in situations like that .. 1) refund your purchase or 2) give you back part of your purchase price.

The problem is that the seller is only protected by Ebay for option #1.

I doubt there is a way within Ebay to refund part of the purchase price so the seller would likely have to do that through another means (ex: PayPal).

The seller could send you back part of the purchase price and then you could turn around and demand a full refund and ship the item back. Within Ebay's system the seller would have no choice but to provide it. That way, you get all your money back along with a nice bonus.

That is why Ebay strongly encourages (maybe even requires) sellers and buyers to use their systems for everything, partly of course to get their full cut but also because it provides a full audit trail of all actions and communications made during a sales transaction.

As I said, I am not saying you are wrong to be upset. I would be as well and while I have not bought a ton of things on Ebay, there have been a couple of times where the condition of the items I got was worse than what was listed. In those situations, I had a choice to return the items or keep them and, in the end, I wanted the items more than I wanted my money back.

I haven't used eBay in years. I had one bad experience and that was it. I needed a replacement motherboard and found the exact model on eBay. It was cheap and the seller claimed it worked. When I received it and installed it, it was dead. I don't believe anything anyone sells on eBay. I would write a negative review and if there are any negative ramifications for doing so then I would take it up with eBay. My only advice is be honest in the review. Don't exaggerate. If you can include pictures of the damage do that. I wrote a negative review on my purchase and the seller was defensive claiming the MB did work and I must have done something wrong but I knew I was right.

I think at this point, he just wants to warn other potential buyers of a dishonest seller.

@Mannix ,maybe the best thing to do would be to write a lukewarm review. Don't bash the seller, to make it seem like you want your money back, but just say something along the lines of, "Well , it was a little more scuffed up and used looking than I'd expected, but for the price it's worth it."

Ebay buyer protection is really good. He gave you the option of a full refund and you refused. I'm not sure what else you want. Your review, especially if he is a big seller, won't have any impact on his business.

Give them (seller) a chance to make things right again.
Whether replacing an item with a newer item. .. or supplying a full refund or half refund.

I think even Ebay site will strongly recommend negotiating it out between the two parties.
And when there's no resolution, Ebay will step in and arbitrate.

Be sure to read the fine printing before purchasing ... Some sellers offer to accept return items; ..some do not..

Yeah, eBay doesn’t care. He offered a resolution that would have made you whole. Seriously, it’s a waste of your time.

I bought an external sound device for my computer like 6 years ago on ebay, and it was new unopened and worked fine.
you should always look at a few reviews, and their rating and read their post and sort of analyze it.

you picked a bad one, as he said it was new unopened, and then said it had scuff marks lol, so that should have told you it wasnt new.

you could do a review to let others know they are not new, might save someone else the irritation.
If I read that on a seller on ebay or amazon, I dont buy from them.

..hell with that. I've been a member since 99'. That's blatant used, no bones about it. Take some shots, from best angles. Send it back and demand refund.

I stopped using Ebay couple of years ago. It's become unethical and shady the way it's being run. Hopefully, your case turns out well.
