SAN DIEGO – An effort to free whales from SeaWorld by claiming they were enslaved made a splash in the news but flopped in court Wednesday.
A federal judge in San Diego dismissed an unprecedented lawsuit seeking to grant constitutional protection against slavery to a group of orcas that perform at SeaWorld parks, saying the 13th amendment applies only to humans.


"As `slavery' and `involuntary servitude' are uniquely human activities, as those terms have been historically and contemporaneously applied, there is simply no basis to construe the Thirteenth Amendment as applying to non-humans," Miller wrote in his ruling.

I always wonder why they would bring such suits because in the end they just look stupid. Yeah it gives them publicity but in the end, they look stupid.
 
Any and all lawsuits IMO should have to be approved before they can actually executed. This would probably kill at least half of Apple's lawsuits.
 
Real scoop is since the court could not give the Whale a jury of his peers, because they would not fit in the courtroom they had to throw the case out. :lmao:
 
Whales shouldn't be kept in captivity, but not because PETA says so. Because they are dangerous.

Tillicum is a tad evil but for the most part, they are "tame". They really aren't that bad.

My son loves Shamu so we had to tell him it wasn't Shamu that killed the trainer but Tillicum (he hasn't figured out that all the killer whales at Sea World are "Shamu").

Some of the things that they do actually hurt their cause . I will not support this organization due to their antics . I may agree with them on some issues , but they lack commom sense .

Same here. It tends to be the case with many activist groups. They always take things too far

I think Shamu has attacked trainers before also.

I understand that these instances are rare...maybe 1 in 500,000. But is that one time worth a trainer's life?

Ask the trainers if they think it is worth it?

I admit I have mixed feeling. I think for the most part these animals should be free but I also know that because of the whales you see at places like sea world it gives people a greater awareness of these animals and understanding of them which I think benefits the entire species
