need legal advice

I need advice on what to do. My grandmother passed away 3 years ago and didn't leave a will.The estate is to be split up between myself and my two uncles. My oldest uncle was named executor. There is not much in the estate, but she did leave a house. The estate can not be cleared until the house is sold. It has been on the market for three years. My uncle has made no attempts to sell the house.

I really just want to be done with all of the drama.. I don't believe my uncle is doing everything in his power to resolve the situation. Are there any steps I can take towards relinquishing him of his executor position? Should I get a lawyer?

just some more back story.

I'm a 23 yr old grandson with a high school education that lives 200 miles away. i really have the least rights to be the executor

executor is late 50s drunk that sponges off your tax dollars and has been since about 35. he hates his brother and i think is making no attempt to sell to keep him from getting any money.

the brother is a coke head who rented the house for a few months till he skipped town left the house trashed, didn't pay rent and had to be evicted.

you think i have a case or will the legal system decide i am the young kid and it should be left in the hands of 'more responsible' adults

Who is paying the taxes on the house? If it's your uncle, he might stiff you when he does sell it for back taxes.

Honesty, you should be asking questions like this here. Just call a lawyer and ask your questions.

If you do get a lawyer, it will probably cause quite a bit of friction between you two. If you can't get him to settle it, then a lawyer is your only real option IMO.

Probate is a different animal. Get a lawyer who specializes in Probate Law.

I would say that if your uncle has "been appointed an executor," and there is no will, he likely has a lawyer. And if that's the case, the estate may have been already closed. At any rate, you need to get a lawyer to check all that out.

i have no idea, i assumed it would be taken out of the house money. there is already friction, once this house is sold i will have no ties or contact with any blood relatives(other than my cousins) for the rest of my life. my blood family aren't the best people in the world. i think i will call, thanks

he does have a lawyer, my other uncle got one as well because he thought his brother would sell the house for a dollar just to spite him, but the state appointed the oldest brother executor anyway. thanks for telling me which kind of lawyer to talk to, that helps a lot.

thank you to everybody, yesterday i told my uncle i was getting a lawyer, today i get a call and the house has magically sold and and they are sending the check FedEx lol. now i just need to know how much to set aside for estate taxes.

Congrats on finally closing that door. That has to be a big relief. Good luck the rest of the way.
