The Bakersfield (CA) district attorney announced Wednesday that Cardinals OLB Joey Porter will not be charged with DUI.

He was also accused of assaulting an officer, but police appear to have botched this one. The D.A. hasn't yet given an explanation, but the arresting highway patrol officer is under investigation for police brutality. Porter alleges that the cop pointed a gun at him. Porter should avoid discipline.

Joey Porter will not faces charges stemming from his arrest on March 27, the district attorney in Bakersfield, California said Wednesday. Porter was arrested for DUI and assaulting a police officer.

Porter was arrested early Saturday by the California Highway Patrol after he pulled up behind another motorist they had stopped. He was accused of slapping an officer's hand and exiting his car in a "confrontational manner."

It's unclear why the district attorney's office is not pursuing the charges. The California Highway Patriot officer that busted Porter has since come under investigation for brutality.

Seems like the camera caught something worth investigating. Good for Porter.

It still doesn't change the fact that he was probably drunk driving, so why is it good for him?

Maybe it wasn't drunk driving. Maybe it was a pissed of Deadskin fan, angry he yoked the skins for a bigger contract with Arizona.

he was drinking and driving. Reports say his first BAC was .07 and the 2nd one was .08

From what I've seen the dumbest people are on the front lines. This cop was obviously stupid, as is a lot of them. These guys are stupid. They want to resort to force first and get information second. A lot of people don't like cops and do observe the same thing. Law enforcement has the brute idiots on the front lines who abuse citizens and then the citizens who have knowledge of the law fight back and win. The rest take the crap and suffer the consequences.

Yea, "stupid cop". These guys put their lives on the line everyday. Some have been shot during normal routine traffic stops.

Course, had the moron, which is INDEED Porter, NOT been drinking and driving, CAUSING this whole ordeal, maybe there wouldn't be a need to pull him over?

Regardless of the fact that Cardinals linebacker Joey Porter won't face charges in the wake of Saturday's arrest outside a Bakersfield, California Taco Bell, the situation could have played out far differently but for a decision made by the local Sheriff three years ago.

Per initial reports, the police officer who allegedly slapped Porter in the face during a DUI stop eventually pointed his pistol at Porter, who continued to move toward the officer. If true, it's a good thing Porter didn't have a gun of his own.

According to KGET-TV, an NBC affiliate, Porter previously held a concealed weapons permit. The Kern County Sheriff's department revoked it after Porter was cited in 2007 for beating up former Bengals tackle Levi Jones.

"As the Sheriff I have to be comfortable with people that have gun permits. And some things happened in Joey's life that made me become uncomfortable with him being able to conceal a firearm," Kern County Sheriff Donny Youngblood told KGET.

None of this means that Porter would have reached for his gun if he'd had one on him when things got hectic on Saturday. But it was an emotional situation. And Porter is an emotional guy. In hindsight, Youngblood made a prudent decision.
