A offer to settle the case of a Nevada woman’s claims that Ben Roethlisberger(notes) sexually assaulted her in 2008 no longer is on the table, her attorney tells the Pittsburgh Post-Gazette.
"The deadline for that has passed," said Calvin R.X. Dunlap, the attorney representing the 32-year-old woman who has accused Roethlisberger of sexually assuanting her at Harrah’s Lake Tahoe when she was a VIP host there.
In August 2009, the woman filed a civil suit against Roethlisberger. In September, Dunlap offered to drop the lawsuit if the Pittsburgh Steelers quarterback admitting assaulting the plaintiff, wrote a letter of apology and made a $100,000 donation to a Reno organization that helps abused women.
Roethlisberger’s attorneys rejected the offer. One representative, William D. Cornwell Sr., called the offer "bizarre" and a "farce."
The lawsuit is waiting to go forward as the Nevada Supreme Court considers a change-of-venue appeal by Roethlisberger’s attorneys. They also have asked that the plaintiff be required to have a psyciatric evaluation.
According to the Post-Gazette, Dunlap said if his client is required to go through a psychological evaluation, Roethlisberger should be required to do the same. Dunlap would not comment on whether he would seek results of the behavioral evaluation that NFL Commissioner Roger Goodell ordered Rothelisberger to undergo.
"The sanctions imposed by Commissioner Goodell are the business of the NFL, however, the behavior of Mr. Roethlisberger in Tahoe, in Georgia, in Las Vegas and elsewhere will be part of the business of our lawsuit," Dunlap told the newspaper.
