For refusing the Pbt as is Wisconsin's policy. The preliminary breathalyzer test or pbt is not the test that would be used as evidence in court. It is used to determine probable cause for an arrest, which would lead to testing either with a more advanced and certified breathalyzer or a blood test.

If you have a report showing that Romo continued to refuse the official intoxication test after his arrest and having been informed of the implied consent laws then I'd love to see it.

He himself stated on camera that he would "do that" in reference to the officer telling him he had the right to choose his own facility to have blood drawn at his own expense.

A quick google search listing the four citations he received is only a fraction of the story and does not speak to what happened after he refused the pbt and whether a warrant needed to be issued after he seemingly agreed to the blood test on camera. If you can point to something that clarifies all that please do. As of now we just don't know.

Like it or not he received the citation. It’s not like he’s going to jail over it. It’s a civil citation. Not criminal. The irony is the penalty, in Wisconsin, for refusing the chemical test after you’re in custody is harsher than the penalty for a first time OWI. Bigger fine and loss of driving privileges for a year. Note, Texas does it the same way.

Like it or not he received the citation.

Yes he did. Me liking it or not is irrelevant. I have no dog in Romo's fight and I really don't care beyond the interesting reactions and the resulting dialog.

This entire back and forth between Streetwise and I has nothing to do with whether Romo is innocent or guilty. It is just about the claim that Romo refused anything other than the preliminary breathalyzer test and whether he forced the officer to get a warrant. He initially refused the SFST but then did it. That doesn't prove anything regarding the chemical test, but it does indicate that he may not have stubbornly stuck to his initial decision to refuse the chemical testing.

I've only made the point that there is no evidence that he continued to refuse further intoxication analysis after he understood that he was required to submit and that a warrant would be issued if he did not submit. That is the only aspect at issue in this back and forth.

The officer told him they would get a warrant. Romo indicated he would choose the option of getting a blood test at a place of his choosing at his expense.

Those are all the facts we, or any news outlets, have to consider at this time. The obvious conclusion is that we, and the media vultures, just don't know how that turned out.
