Yes and they are going to be extremly surprised at the end of all this when they lose and losing would be horrible for the league.
Offseason deal is coming. Two games, DV wording is dropped and replaced with poor conduct.

That's just what you want to happen.

They said the same thing with Brady. He lost. I don't see why this is any different. Goodell has the contractual authority to be this corrupt.

Fundamental fairness takes precedent over article 46.
This is a criminal legal matter with real life consequences.

Brady’s was about cheating. That to me makes them fundamentally different. We’ll see what the courts think, but so far 4 judges said he didn’t receive fair treatment and one worded his ruling very strongly.

The NFL's requests in this case have been silly to me. There's really no reason for his punishment to be expedited because he can serve the six-game suspension at any time. The NFL acts like he's got to be suspended right now or it's going to do some kind of irreparable harm. The only one who stands to be harmed is Elliott if he's allowed to be suspended before his case is heard.

Of course, this isn't about right and wrong for the NFL, it's about power. And the league needs to be slapped down for abusing it.

Yep. The NFL and Goodell thinks it is more powerful than it is. And it's not. These judges don't care about what entity comes before them. It's just a case to them. Goodell will have to wait his turn like the rest. The world does not revolve around the NFL like they want to believe.

I think the NFL really believes that this whole TI request is a waste of time for all concerned. In their eyes the judge should not look at anything else but article 46. Fundamental Fairness be damned!

The last judge literally said that he read the Brady case and the same does not apply to Zeke. Which, to me, was a huge takeaway of his ruling.

Did the NFL want to move it up three days? I thought I saw a blurb on TV that the NFL wanted to speed it up to the 27th. The NFL sure is in a hurry.

I would suggest reading some in depth Daniel Wallach articles. Fundamental Fairness Isn’t something that the union bargained away. The Brady case is apples to oranges- the 2nd Circuit felt it was too abstract- Zekes case is much different- as Judge Crottt plainly said in his TRO ruling- the NFL is ‘quite wrong’.
The NFL is desperate not the have the Brady ruling further defined, thus ruining their own overly broad definition that they feel throws out all fundamental fairness issues.
The eventual ruling in this case will have broad consequences for all other employers in regards to arbitration rulings.
My gut tells me the courts will err on the side of constitutional rights.

If zeke loses on 10/30 then what? Is this final?
If he loses then he appeals to the Judge and to the CA2 for a reversal..... he may miss a week or two while they act since the injunction will not be in place... it would be a huge blow

This ruling is big though....if he gets it he plays the whole year and the rest is settled in the Spring

Zeke only lost the intitial TRO due to filing error by the NFLPA, not because of lack of merit, as well. I think he's got a solid shot to have this TRO stay. Judge Crotty gave kind of a wink to the vacationing judge with the wording of his ruling, and yes, called the NFL "quite wrong" for thinking they can do whatever they want based on Article 46. That's huge.

Brady was treated fairly....... he was just Guilty

But he still had good arguments on Notice and Equal Punishments....... the League never told anyone they could get 4 games for tampering with equipment and others that messed with the balls only got 25k fines...... he could have won those on appeal ...... he still had 2 out of 4 judges side with him

The NFL was on its irreparable harm BS so it had to happen yesterday.

One comment I noticed from an NFL lawyer really steamed me. He said Zeke's reputation is already tarnished so there is no irreparable harm now. OK BOZO who is the one entity MOST responsible for the damage to his reputation? I really hate lawyers, politicians, used car salesmen and other PROFESSIONAL LIARS.
Maybe Zeke can use that to sue the league if he can get the suspension overturned (unlikely to happen).
