My apologies if this aspect of the Keith Davis situation has already been discussed... and I might be completely off base here, I'm not sure.

But here goes...

After the shooting, Jerry said Keith will have to pass "their physical" in order to suit up, right? Davis received a $1.2 million signing bonus when we matched the Saints' offer sheet, so cutting him outright would be tough...

It has been speculated that Jerry may be looking for a loophole in his contract to take back the $1.2 mil, so he can cut him without the cap hit.

Could a possible loophole in the contract be... (drumroll please)

A "failed physical"? It's "their" physical, they can fail him if they want... right?

Maybe Jerry wasn't even sure if they were going to cut him or not. Maybe the "physical" line was used just in case they decided to cut him a week or 2 later, pending more details on the shooting.

Does anyone know if Davis was already on the plane or in Cali when the news of him lying to the cops was leaked?

Assuming there's no huge holes in my conspiracy theory, I think Davis could soon be cut... after "failing" the custom physical given to him by the team. With a big fat $0 cap hit.

Yeah... that's all I got.

More likely, if you ask me... Davis just isn't very injured, he's able to go from day one in training camp, and the team just goes ahead like the shooting never occured.

Davis just competes for the FS job like was planned and nothing comes from the shooting.

That is what I think will happen, although I could be wrong.

This would not surprise me at all and in truth, I thought about this but I am not versed enough in how a release of a player in relation to injury due to none football related activities impact the cap.

I do think that it is a definate possability though.

I think if recaturing bonus money (real or cap impact) were as easy as a "failed physical" three months later there would be other publicized incidents of that.

Color me skeptical.

I do know the Cowboys have done some contracts (rookies I believe) with a clause that reduces the amount they get paid if they're on IR. But I doubt they can get away with that for a vet.

I don't think that a failed physical gives a team a reason to drop a guy after he's signed the contract. Usually physicals are only issues before trades or contract signings, i.e. agreement in principle pending a physical. But I could be wrong.

I thought about that, but I'm thinking it could be different in the case of an off-field incident like a shooting. Not sure, though.

It might be hard to get any money back because, first of all, the team would probably have to prove that the player was actually neglegent in causing the injury, and secondly, if a player was an innocent victim, then the team probably cannot get any money back...

That doesn't mean though that he doesn't have a clause in his contract... like a dangerous activities clause. You know how these guys have clauses saying they can't ride motorcycles, etc. Not saying Davis has one, he probably doesn't, but it's a possibility given he just signed a new kontract and he has a past.

No it probably does.

Probably says something like "Don't get shot in a drive by, at 5 in the AM, while on your way to Church."

My guess is that if they can use the non-football injury as a way to get out of paying his bonus and can cut him loose as a free agent, they will do it. It will be interesting to see whether NO will make him that same offer again.
