How do you like those apples cowboys fans? That the players are saying, we dont serve you the fans in a way too, were only out for ourselves, 1900 of us as players. This was on NFL Network about 1:58 pm

Reluctance to reconstitute union is another red herring

At the top of the hour on ESPN, Sal Paolantonio reiterated what we’ve been saying for weeks: “We keep hearing from a lot of owners here that . . . Jeffrey Kessler is holding up this deal.”

Kessler apparently is holding up the deal in one way by ignoring all modern means of communication to insist on sending out union cards in the mail for players to sign and return

This is one time when the Judge mediating the process, steps in and clears up the digging in of heels that is aimed at just agitation at this point.

Smith said recertification of the union is a serious issue that the players will think about individually.

Think carefully guys because you blow this at your own risk

Recertification is not a question at this point. Period. It takes collective bargaining for a true partnership to occur and to carry through on elements of authority and legitimation of it as well.

If the players don't realize this by now, they should just retire and commit themselves into a nursing home. Then burn their degrees.:eek:LOL...

I agree. For a CBA to exist they have to recertify if not then all this work was for nothing. It would also mean any form of sharing of revenue would not exist or any benefits would not exist

LOL!

Just when victory is so near, Dmoron Smith raises his ugly head once again.

Man this guy is the worst person for this job. He doesn't want the Union to re-certify. That would mean he wouldn't get a chance to sue the league in court and it would mess up all his plans.

This man is truly a blister on the foot of every NFL fan, player and owner.

De Smith addresses recertification issue
Posted by Mike Florio on July 21, 2011, 3:22 PM EDT

Getty ImagesIn a surprise appearance before the cameras and microphones parked outside NFLPA* headquarters, executive director DeMaurice Smith talked about the question of whether the trade association will lose its asterisk.

“Look, we visited every team some four times over the last two years,” Smith said in comments carried live by ESPN and NFL Network. “The decision by the players to decertify as a union was a significant one. And I think most of you remember by neverending road trip where we went team-by-team to talk about the issues of decertification.

“I know from yesterday that the issues for every player about recertification as a union is going to be an important issue, and here in America every time an employee makes that decision about whether he wants to be a part of a union it’s something that is serious, significant and should be done in a sober way. I know there’s a lot of questions swirling around, and I know from watching the folks at NFL Network that they’ve become experts on the recertification issue.

“Let me tell you, every individuals person has to make a decision about whether they want to be part of a union. And recommendations made by the Executive Committee as the advisors to the class or the board of directors as advisors to the class are just that. But the individual decisions are something that our players take extremely serious.”

Here’s how a deal can be done, now

Posted by Mike Florio on July 21, 2011, 3:38 PM EDT

This isn’t speculation. This isn’t a hypothesis. This is fact.

The NFLPA* is ready to do a deal. The NFLPA* is ready to commit to reformulating the union. But the NFLPA* doesn’t believe that it can be done without signed union cards.

And it won’t take two weeks to get the signed union cards. The NFLPA* is willing to agree to the proposed settlement and to commit to reforming as a union. The NFLPA* simply wants to wait until camps open to physically collect the cards.

The problem is that the NFLPA* believes that NFL lawyer Bob Batterman (pictured) is demanding that the owners require the NFLPA* to immediately reconstitute. And for the same reason that some owners think NFLPA* lawyer Jeffrey Kessler wants to blow up the deal, the NFLPA* now thinks Batterman wants to blow up the deal.

Right, I was talking about what albert breer said de smith has said all along at about 1:58 pm on NFL Network. That we dont work for the owners or the public. Foxworth or some player for the union decertified, said same thing, were not in this for the owners, or the public, were in this for the 1900 members, which to me when you say were not here to serve the public, de smith and the player, your snubbing the fans, the public. Saying, forget you, we dont care how long this takes, till we get our demands met, were not signing, if you as fans miss football, thats tough. The owners have to get in to us, or else we wont sign, and no union, so no football. WE WANT OUR MONEY< forget if it costs you fans more through tickets, tv sports, souvenoirs, parking etc... we want our money, we could care less about the public. :banghead:

Honestly they don't serve the fans. I agree with him. Sure it's not the PC thing to say but he's absolutely right.

Unless I have missed something the fans have not earned any benefits during this entire process. Ticket prices will be the same. We'll still get charged oevr $300 for Sunday Ticket (unless you're a new customer or threaten to cancel). Concession prices will be the same. Etc.

This entire issue is stupid. In 1987, the NFLPA decertified, resulting in a strike. Due to lack of foresight - no strike fund - the players went back to work, and the union filed a new anti-trust suit.

The suit failed, as the court held that as the NFLPA was still representing players, the anti-trust exemption from the previous CBA still protected the owners. It was only after the union completely disbanded and refused to represent any player that a new anti-trust suit was filed and accepted by the court. The union did not ultimately reform until 1993.

What does this mean for 2011? If the NFLPA* and players approve the CBA, the owners have anti-trust protection whether or not the union reforms.

I'm positive the NFL legal team, as well as the owners, are aware of this. Whether or not a union exists, the NFL can present to the court a new CBA, and the anti-trust suit as currently constituted, goes away.

This leaves two options: the NFLPA* does not approve the CBA and the suit continues, as well as the lockout, or the CBA is approved, but the named plaintiffs decide not to join the new union, are individually locked out, but can file a new anti-trust suit themselves, without any assistance from the players association.

Totally disagree, now do fans ultimately pay the players salary NO! But in a big way we do. Owners sell jerseys, souvenoirs, tickets, suites, parking,TV access through direct tv or cable, etc to the fans, that money gets divided up by the players and owners in their bargaining. Thats why the players are fighting for more, the players and owners say right now the revenue from fans, tv, etc totals about 9 billion, they see that going up to 18 billion in a few years.

So, in a way, we pay the players salary.

If it wasnt for fans, would there be any football or do fans watch pro football on tv and pay the tv bill? Yes!

The owners get that money, and the players get last year, after first billion was taken off the board, the players got 60 cents of every dollar, now the players will get 48 cents of every dollar as i understand it, but the owners dont get any billion off the top.

So, now who pays the players salary? Should the players, union etc be mindful of us?

Let me know when this thing is over, or not.

Players & owners owe me nothing. I owe them nothing. Much as I love the Cowboys and the NFL my life would go on quite nicely without them. Frankly, it would probably even be better.

It's a stupid little thing with me but I refuse to wring my hands even once about when or if a deal gets done. It's simply not that important. And I think the longer this goes on the more fans will realize this to be so.

Short answer, no. Unless even a sizable minority of fans (25%+) organizes and goes on strike - TV and attendance - there is no reason either party should be mindful.

De Smith just talked on NFLN.......every other word was "Uh" or "Um"....was the most annoying thing i've ever heard. Just wanted to smack him.

Just because the fans pay for the league, doesn't mean that the players serve the fans.

This is a job, its an occupation.

They aren't slaves, and they don't have to enter into any agreement that puts their ability to procure income in jeopardy.

Smith should be killed. The players don't seem to understand that the NFL will not exist without the union. They are absolute moron being lead by a moron.

...and people can't figure out why most non-lawyer/sane people side with the owners here?!?!? :bang2:
