The NFL is getting slammed today by the judge. Even still, I'm in awe from watching David Boies be as good as he is.

David Boies is so good he could talk a horse out of eating hay. But this judge seems pretty set on siding w/the players.

NFL outside counsel David Boies just went another 55 minutes before Nelson. That gives him almost three hours for the day.

... "These folks can disclaim if they want, can't they," Nelson said. "It's a big risk on their part. They risk a lot by doing it."

This sounds more like positioning for an appeal rather than argueing for a judgement.

I'm going to go out on a limb and say there will be no football this year.

That's my prediction.

He is arguing the Norris/LaGuardia Act could prevent her from issuing a ruling on the injunction. If she can't rule on it, then there would be no appeal. (although if she did, they could use it as grounds for an appeal)

Like many of you, we’ve been monitoring today’s developments in Minnesota federal court via Twitter.

By most accounts, Judge Susan Nelson peppered NFL counsel David Boies with questions, while asking far fewer of his counterpart, Jim Quinn.

(Curiously, the players opted to put Jeffrey Kessler on the sidelines. It possibly means that NFLPA* executive director DeMaurice Smith realizes that Kessler, when speaking in court, can be a tad abrasive.)

In my own experience, the side that gets the bulk of the questions is the side that is teetering on the brink of defeat.

This is cool stuff. I know most people hate the labor dispute, but for lawyers who are football fans, it's fascinating.

Greed will probably prevent it, but it's not totally out of the question either.

All done here. Judge Nelson says shell take case "under advisement", that it'll likely take her "a couple weeks" to rule. ..

... In the meantime, she advises parties to return to mediation, only this time to do it in federal court setting.
