Borgata Casino Lawsuit Alleges Gambler Cheated, Won $9.6M

An Atlantic City casino is suing a big-time gambler, claiming he won $9.6 million in a card-cheating scheme in baccarat.

The Borgata Hotel Casino & Spa filed a federal lawsuit Tuesday against Phillip Ivey Jr., considered one of the best poker players in the world.

The lawsuit alleges Ivey and an associate exploited a defect in cards made by a Kansas City manufacturer that enabled them to sort and arrange good cards in baccarat.

The technique gave him an unfair advantage on four occasions between April and October 2012, the casino asserted in its lawsuit.

The casino claims the technique, called edge sorting, violates New Jersey casino gambling regulations. Its senior vice president, Joe Lupo, declined to comment on the lawsuit.

He is definitely considered the best player in the world, and for good reason (cash AND tournaments). This sounds more to the fault of the card manufacturers then the players who picked up on the defect of the patterns on the cards. Outside of him asking for an automatic shuffling machine, as opposed to a human dealer, is the only fault I can see on his part. It is not an uncommon request by players (superstitious thing) especially in high stakes games. Gamblers are always looking for an edge, but this seems like the lawsuit should only hold if Ivey and his accomplice were linked to the KC card manufacturer, and that article states they aren't. I can't even recall how many stories of casinos "altering" the rules/requirements, after the fact, for bad beat jack pots. "Yes, you had hit the bad beat, but it wasn't before 11:00 AM and the clouds were out", or whatever reason they come up with at the time to justify not paying it out. Casinos are so backwards sometimes.

Doesn't sounds like they have a good case. He didn't supply or alter the cards. He just took advantage of the existing defects in the cards. The casino needed to do a better job of monitoring what was happening.

It reminds me of pitchers in baseball. They will look for scuffs in the ball that they can use to their advantage. As long as they didn't put the scuff on the ball themselves then they haven't done anything wrong.

That's the way I saw it too. Casinos can get tricky with those "in house" rules like with card counting in black jack. Like you said, tighten up your ship and this wouldn't have happened. Feels like sour grapes.

I'm shocked the casinos don't have a computer system in place that scans every single card they will ever use to make sure the backs are 100% identical.

They probably do in Las Vegas. Atlantic City has always been a step behind.
