"loser pays" is the law in Texas. Of course, getting a judgment for those fees is very different than actually getting paid for those fees. If you have nothing to lose, there is no deterrent.

Seems to me Texas laws should apply in a lot of states. Did the non-existant seats ever get installed? They might be needed for the playoff games this year.
