Well certain things are generally not defamatory. For instance a report made to police is not defamatory. Testimony i court is not defamatory.

The statute of limitations runs from the date the untrue statement was made (with publication--meaning others heard it) and it damaged his reputation in some way. His claims against her initial defamation has likely already run (unless he filed suit and no one knows it because he didn't serve her).

If he has a defamation suit against the NFL which be novel (but speculative) it would be at the time the NFL published (made known to others) defamatory statements. So the statute of limitations probably commenced running the day the initial ruling was published (disclosed).

That would be a hard row to hoe against the NFL for many reasons. But if you could get it to a jury you you lay the wood to the NFL.

This is an excellent read and perfectly sums up what has been troubling me about this whole suspension/arbitration process.....Publicly convicting someone through a kangaroo court that will damage someone's reputation and change their life. That's why this smells like libel/slander.

I would be suing the hell out of the league. Too lable someone a wife beater...he's gonna have to carry that for the rest of his life. How much is that worth? Ruining a guys life? In his case...10's of millions. Not just in lost wages as a player..but in lost revenue in what ever he decides to do after football. No commercials...no endorements. I bet he could make a very solid case that this is gonna cost him over a 100 million over his lifetime.:rolleyes:

In the end I hope zeke ultimately wins and sues the crap outta the NFL, Goddell, Friel....etc for defamation of character....i hope they are forced to have to pay him millions $$$$....

True, but the clock would likely start either the moment he loses his final ruling or the moment he misses his first game, so he should have plenty of time to file if he chooses to do so.

One wonders if the final gavel needs to be hammered for Elliott to prove harm. He must suffer harm or it is near impossible to prove harm in a libel case. Now I'm not an attorney, so that may be incorrect. But it seems this has been stated over and over in different cases that played out in the press.

He cannot show the league knowingly made any false claims about him. The fact that he can show there isn't enough evidence to legally charge him with a crime is irrelevant.
I believe he has a leg to stand on by using the league office against it's self. The fact that the league's investigator made a report recommending no discipline and Goodell ignored that report and suspended him anyway may give Zeke an avenue to sue the NFL or Goodell. I don't think it would be a good idea for Zeke to sue Tiffany Thompson. It wouldn't look good and it would be a lot of drama. Also she's been through enough. She's irrelevant now. This is between Zeke and Roger and Roger ignored his own chain of command and his own "due process" and suspended Zeke. I think he could outright sue Goodell for damages cuz Goodell is doing more to defame Zeke than the girl did. This almost seems vindictive on Goodell's part. Ignoring your own employees who didn't come up with a reason to discipline Zeke.

If I recall, the latest ruling specifically mentioned that the league investigator made no recommendation for discipline. She questioned the reliability of the accuser's statements and shared that with Goodell but did not make any comment on whether or not Zeke should be punished.

Zeke isn't experiencing criminal prosecution, unless he's locked in a jail cell somewhere.

He's a suspended employee. In his case, unfortunately, it's a national story. That comes with being a star on America's Team.

24 owners have to approve an extension. I think his chances are steadily dwindling.
Thought I'd heard the 'extension' had already been approved back in April yet the details of said extension were to be worked out later and it would take 24 owners to overturn the already agreed upon extension,,, think that's what my T.V. told meo_O

He has had no positive impact ln the league. The NFL would’ve seen similar revenue increases if a hamster was commissioner. It’s an exciting, modern sport compared to other slow pace sports that have 50+ meaningless games a season.

The only positive I can think of that has been added to the game during his tenure is increasing the length of extra points.


That was the competition committee.

Great article and I agree completely. Reckless disregard for the truth is what he has here. They did not care whether he was guilty or not.

that is what he can sue on; that they knew it was very questionable at best and still did it; and also he can add they threatened him that one more incident would result in a lifetime ban.

I had thought that they still needed 24 to complete the deal once negotiated. Oh well. Still if things like ratings keep dropping and other things happening I can still see where he gets the boot. OR they table the extension expecting him to make things better.

The NFL's own lead investigator recommended no punishment. Goodell ignored it. I think that could be used against them.
