Foreclosure Question

For anyone who would know, if the contents of a Foreclosed property has been placed on the curb of the property or even on the lawn, is it legal for someone to walk up and start taking those items?

The city where I live has a message board and one of the posters said that in his neighborhood, people started walking up to the lawn of a foreclosed property and just started taking couches, tvs and things like that.

I always thought items at the curb were considered thrown out or discarded and fair game. As for just on the lawn? I wouldn't think so.

I'm sure it depends on conditions. I can't imagine where the owner of these things would be if not there, and I could also understand that some might think it's just left there to be discarded. If it belongs to someone, they should at least try and put up a sign saying it's not for trash pickup. Any one taking things at that point would obviously be stealing.

Going up on the lawn takes it a step closer to theft also.

If his stuff is being tossed without his knowledge of the time, it's probably theft. He can contact police if he knows who took what and try to get them to give it back.

What a lousy topic of discussion. Being foreclosed on and having your furniture taken.

I can't imagine taking something that's not yours is legal, regardless of where the owner is stuck putting it at the moment. On the curb is a legit excuse for thinking it was trash, but on the lawn, on the property sounds like trespassing and theft.

Usually if the property is already foreclosed on, then everything that remains on the property is owned by the foreclosing bank/company.

They property owners (pre-foreclosure) get plenty of notice warning them up to the date that the property will be foreclosed on, to remove all items. Many people take this to the extreme, and take things like toilets, door knobs, and other built in fixtures. Some are so bent over the ordeal, they literally destroy the interior of a home any way possible.

Foreclosures are ugly, ugly processes.

Going onto someone's lawn and taking stuff is theft, imo....unless there is a sign saying otherwise.

If it's left on the public curb (other side of the sidewalk) then it's probably legally fair game.
