Attorney: Gretzky won't face criminal charges

TRENTON, N.J. -- Wayne Gretzky will not face criminal charges in connection with a multimillion-dollar sports betting ring busted in New Jersey last week, and he is unlikely to be called to testify against others in the case, his lawyer said Thursday.


Attorney Ron Fujikawa said he received assurances from New Jersey authorities last week that the hockey great was not in any way a central figure in the criminal investigation. That's not surprising, Fujikawa said, because Gretzky did nothing illegal.

"He is not a person of interest," Fujikawa said Thursday. "We have received no indication he is somebody who will be called before a grand jury. We have received assurances that he is at most a fact witness."


A fact witness is someone interviewed informally by authorities, the lawyer said.


Gretzky's wife, Janet Jones, also is unlikely to face criminal charges in the case, her lawyer said Thursday. Jones wagered more than $100,000 through the ring, a person with knowledge of the investigation has told The Associated Press; her husband was not directly implicated.


If correct, the attorneys' statements indicate that the first family of hockey at most placed wagers with the ring but had nothing to do with its operations.


Under New Jersey law, it is not a crime to place a bet, even if the wager is with a bookie. People who place bets for others can be prosecuted, however, as can people who profit off someone else's bets.



Jones' lawyer, Evan A. Jenness, said she expected Jones to be subpoenaed to testify in the case. She said no documents had been served as of Thursday.


"I've been told she's just a witness," Jenness said Thursday. "I'm quite confident that's the case."


Jenness did not say whether Jones, an actress who lives in California, planned to assist officials. But Jones' spokesman, Elliot Mintz, said Thursday that Jones "plans to fully cooperate with the authorities."


Jones and Gretzky are in Italy for the Winter Olympics. Gretzky, head coach and a part owner of the Phoenix Coyotes, is executive director of Team Canada, the defending hockey champions.


John Hagerty, a spokesman for the New Jersey Division of Criminal Justice, did not return phone messages left Thursday. ESPN.com reported that Hagerty on Wednesday said Jones and others could be called as witnesses but indicated she would not be charged.


Al Della Fave, a spokesman for New Jersey state police, said he could not comment on the investigation.


The gambling operation allegedly was run by Gretzky's friend and Coyotes assistant coach Rick Tocchet, along with two New Jersey men, including a state trooper.


The three men had been scheduled to appear in court Feb. 21 to have their charges read and rights explained. But a judge on Thursday approved a request from the men's lawyers to waive their appearances, said Jude Del Preore, the court administrator in Burlington County.


"In light of the illegal press leaks that have plagued this matter and the gross mischaracterization of this case that has appeared in the international media, we are extremely pleased that Rick Tocchet will not be subjected to the further public humiliation a first appearance would entail," Kevin Marino, the defense lawyer for Tocchet, said in a written statement.

But....but.....but.....uhmm....I thought we already decided that Gretzky once weighed they same as Teemu Selanne and since Disney sold Anahaim and they're no longer the Mighty Ducks but just the Ducks, hence Gretzky weighed the same as a Duck and we should burn him?????????

He may not be arrested but his trouble with NHL not over.
Precedent for severe punishment on illegal gambling associations.

Gretzyky/Jones embarrassed the game. (She) Gretzky Jones is dropping Half a million in 5 weeks with an illegal gambling ring involved in interstate consoiracy, gambling, racketeering, money laundering. Wait - thats Gretzky's best friend and assistant coach. Wait ex players of his / nhl are in it. Wait his ex agent and current GM is in it.

But dufus ol simple Wayne was not aware. Either a divorce (Gretzky / Jones) or a duel with Tocchet is needed to fix all the embarassment.

I'm sure the Gretzky kids are proud of Mom and Dad. Friends they have, lil gambling problems. In his position - look at all the attention and shame he's(she's) brought to his team. And he damn well knew all along.

Its like sitting in a car with your wife and best friend. He's driving the car. Your wife had drugs on her in back seat (Jones). They find a Newton like stash in the trunk. They arrest the driver (Tocchet) and Gretzky is not arrested (I dun't know?)

And it comes out Gretzky's agent/GM and ex players were buying drugs from Tocchet too! Compound it Tocchet has a 10 year known association with Cartel guys.


This isso good Hos - great news for Gretzky and the sport. Someone should have the spine to tell the truth on the "Great One". You'd have to almost have no thinking brain matter to not think Gretzky was aware of all this and is guilty by association.

He is an NHL owner and had fiduciary responsibility to uphold the integrity of the game. And ties to illegal gambling rings is real, real bad stuff.

You can have your Great one - he deserves where he is now.

yeah, I'd say his trouble is over. He'll go on coaching (The Coyotes and the Canadian Hockey team) and the NHL will be happy to put it behind.

Update:

Gretzky as predicted - was a major distraction to Team Canada at the Olympics. Result - they did not even make Medal rounds which is unheard of for that hockey powerhouse.

Was he "charged"? No - Gretzky is the great one. He's above all - he'll smile and throw everyone else under the boss. Family and friends -

Tocchet and the Jersey Ring that took the bets and ran the gambling ring will be taken down. Already busted and facing hard jail time.

For those that think Gretzky and his wife betting boatloads of $ with street bookies is "just fine" don't get it. They have not lived and have not seen the dark side of illegal gambling. To put the integrity of the game at risk because of this? Bad

Gambling is a big, big problem. Ruins a lot of lives and is not to be glorified. This is not a Soprano's TV show. Gretzky/Jones dropping $500K here on football games is a problem, major problem.

Ask anyone who's lived the seedy side of the gambling business. Go ahead - they aren't smiling like Gretzky is.
And if there are any who have firsthand seen this evil - they know. And they are here in all walks of life. Some write about it, some deny it and others clean it up.


But like the King - Elvis was above reproach and did as he pleased.......
