Jared Lee Loughner is not competent to stand trial on charges of trying to assassinate U.S. Rep. Gabrielle Giffords, a federal judge ruled on Wednesday.

The judge said his ruling is based on the results of court-ordered medical evaluations of Loughner at a federal hospital in Springfield, Missouri. Two medical professionals did separate evaluations of Loughner.

Loughner, 22, of Tucson, Arizona, is charged with killing six people and wounding 13 more, including Giffords, D-Arizona, who was holding a meet-and-greet with constituents in Tucson at the time of the January 8 shooting.

thought you had to be competent to by a gun and ammunition

One Wal_mart did not think he was evidently.

Wal-Mart Inc. confirmed that Loughner tried to buy ammunition at one of its stores but was refused service due to "strange behavior," according to the FBI. He was later able to get it at another Wal-Mart

Crazy and incompetent are 2 different things to me. He planned out this attack in details then carried it out. That is not incompetence.

I'm not defending him in any way, I just think the guy is crazy and evidently 2mental health doctors felt the same way. I'm sure we will hear much more information over the next few days. One thing for sure he needs to be put away

And he will be. And hopefully we will learn something by studying him.

I disagree.

I watched the video he made on campus and he was not all there. His capacity to function normally (or at least normally to carry out the plan) and his complete detachment from reality are not the same. Plenty of schizophrenics are able to function completely well but are not all there.

A while back there was an elderly man I had a discussion with who was dead convinced that he had worked for the Department of Defense and that he could eliminate any person on the planet with a phone call. He was completely up to date on current events because he was telling me he could eliminate "so and so" (I can't remember who he said specifically, I know he said Osama and this was before Osama was eliminated) with any phone call.

But, with all that he could also tell me his plan for Sunday. His mom was going to pick him up, he was going to go to church and a bunch of other things, all things that were completely realistic. Perfectly capable of describing what he was going to do a few days but at the same time completely irrational and delusional.

I'm not a big fan of the "not competent to stand trial" argument but as long as that is the law, that's what we have to deal with. I'd much rather they just put him down to be honest.

On a side note, I brought this up in another thread but I'm curious what some of you in this thread think about Gabby Giffords being told that she's been in a car accident. I'm not saying it's wrong....I'm just wondering if/when they'll decide to tell her what actually happened and how long they can successfully keep it from her.
I understand that though she's made amazing progress so far, she still has a long way to go before things are back to normal for her. Just wanted to get your feedback.

I think she has a right to know. I think she especially ought to know about the kid that saved her life. I look forward to the day she comes back to Tucson.

The insanity defense should only be used if the individual did not realize what he was doing was against the law or wrong. I really doubt that applies in this case.

A finding of incompetence is uncommon, and when it happens, the competency of most defendants is usually restored with treatment that often involves drugs, Professor Golding says.

...

Golding figures competency is raised, at most, in 5 percent to 10 percent of serious felony cases under the Dusky ruling that most states follow, with slight variations. “When it’s raised, people are found competent about 80 percent of the time,” he says.

Competence and the insanity defense are often confused, says Edward Mulvey, a psychologist and professor of psychiatry at the University of Pittsburgh in Pennsylvania. While competence deals with mental illness in the present, insanity refers to mental illness when the crime occurred, which can be months or years in the past, he says.

Bull.

There are plenty of serial killers who were found competent to stand trial and did so.

Of all of the famous serial killers like gacey, dahmer, starks the only one off the top of my head that was found too crazy to stand trial was Ed Gein.

I know everyone likes to think otherwise...that anyone can just get off by acting crazy...but that is so far from the truth that it is itself...crazy.
