McNamee's lawyers say physical evidence backs drug use by Clemens, who's going back to Hill

NEW YORK (AP) -- Brian McNamee gave federal prosecutors syringes and other physical evidence his lawyers say back the personal trainer's allegations of drug use by Roger Clemens, who returns to Capitol Hill on Thursday in hopes of rebutting the accusations.

Clemens, who gave a deposition Tuesday, is scheduled to hold one-on-one meetings with members of the House Committee on Oversight and Government Reform, two people familiar with the plans said, speaking on condition of anonymity because no announcement was made.

Among the members Clemens is to meet with is Rep. Tom Davis, the committee's ranking Republican, one of the people said. Committee chairman Henry Waxman is not scheduled to meet with Clemens.


McNamee is due to meet with committee staff Thursday morning to give his own deposition, and his legal team said it will bolster his story with details of the evidence.


His side turned over gauze pads and syringes they said had Clemens' blood to IRS Special Agent Jeff Novitzky in early January, a person familiar with the evidence said, speaking on condition of anonymity because McNamee's lawyers did not want to publicly discuss details. The syringes were used to inject Clemens with steroids and human growth hormone, the person said. A second person, also speaking on condition of anonymity, said the evidence was from 2000 and 2001.


"I think this is a significant point in the case. We believe that this is significant corroboration," said McNamee's lead lawyer, Earl Ward.

Lanny Breuer, one of Clemens' lawyers, called McNamee's allegations "desperate smears" and said the trainer "apparently has manufactured evidence."

"It is just not credible," Breuer said in a statement. "Who in their right mind does such a thing?"


In December's Mitchell Report on doping in baseball, McNamee said he injected Clemens 16 times with performance-enhancing drugs in 1998, 2000 and 2001.


Richard Emery, another of McNamee's lawyers, said the committee will be given a description of the evidence that was turned over to prosecutors.

"It does change the nature of the case from a he-said, she-said to something about physical evidence," Emery said.

Doping expert Don Catlin said steroids still could be detected in a sample that old.


"But if you don't find it, it doesn't mean it wasn't there before," said Catlin, who added there are sure to be chain of custody issues.

He said HGH would be much less stable.

After his five-hour sworn deposition Tuesday, Clemens said that he again denied using performance-enchancing drugs.


By denying under oath that he used performance-enhancing drugs, Clemens put himself at legal risk if prosecutors determine his testimony wasn't truthful.


Keith Ausbrook, the committee's Republican general counsel, told The Associated Press the committee was not aware that such physical evidence existed.


"Unknown and unexpected evidence comes in at all times in any investigation," Ausbrook wrote in an e-mail. "We will still need to examine McNamee's evidence and hear what he has to say."


McNamee, the former personal trainer for Clemens and Yankees pitcher Andy Pettitte, also told former Senate majority leader George Mitchell that he injected Pettitte with HGH. Pettitte confirmed in December that he used HGH for two days.


Emery said McNamee's legal team planned to hold a news conference following their client's deposition in Washington on Thursday and will discuss the evidence in greater detail then. Because the items were turned over several years after the events under discussion, Clemens' side could challenge whether they were tampered with.


"Brian McNamee is obviously a troubled man who is obsessed with doing everything possible to destroy Roger Clemens," Breuer said in a statement. "McNamee lied to the police who were investigating him for sexual assault, he lied to Senator Mitchell, he lied to the federal government, and now he apparently has manufactured evidence. He has changed his story repeatedly on this matter. He claims to love Roger Clemens, he says he modeled being a father on Roger Clemens, he said Roger treated him like family -- but he now claims he kept blood, gauze, and needles from Roger Clemens for seven years. It defies all sensibility."


Emery said it was unnecessary for McNamee's side to persuade the Justice Department that the evidence was authentic.


"They'll decide themselves what they believe is the case and make their own decisions based on the facts as they have it. All we know is what we believe is the truth," he said.


McNamee's turning over of the syringes first was reported by the New York Daily News on its Web site.


Clemens and McNamee are to testify at a committee hearing next Wednesday along with Pettitte, former Yankees second baseman Chuck Knoblauch and Kirk Radomski, the former New York Mets clubhouse attendant who pleaded guilty in April to felony charges of distributing steroids and laundering money. He is scheduled to be sentenced Friday in federal court in San Francisco.


"Roger is looking forward to testifying before Congress next week to set the record straight," Breuer said. "He will not waiver, nor will he shrink from this because he is telling the truth. We ask all fair-minded people to listen. It is time for Brian McNamee to be subject to the same scrutiny as Roger Clemens."

I think this is a desperate move on McNamee's part. There will be serious questions regarding this evidence that is apparently as much as 10 years old. This is truly bizarre.

Pathetic - I respect the trainer that refused to turn on Bonds and spent serious time in jail refusing to talk.

This street punk either:

A) Was a steroid supplier to baseball players and is now ratting them out a decade later, or

B) A dealer who was caught up in a shakedown throwing out names to avoid jail time. And throwing Clemens under the bus in the process.

Who keeps syringes a decade? and legaly what is chain of control on this evidence?

It's almost like Clemens is being tried by Congress outside the legal due process system? Specter demanding Goodel meet with him on spygate?

Why and how is our Government doing this? Very McAarthey esque witch hunt.

Yep. You got chain of custody issues, authentication issues, and even if these things were to be found admissible, how can you prove what was in them at that time? Clemens admitted that McNamee had injected him with B-12 and lydocane. McNamee could have kept the syringes, yes. But he could have added the traces of steroids at a later time. It's just not very credible to have the only person alleging the steroid use to have the only evidence from 10 years ago.

The gov't has the authority for all of this. I don't know what this has to do with spygate, other than the Senate's involvement. I don't have an issue with them getting involved like you do.

I don't like this one bit, nor am I taking the trainer's side, but in his defense he was threatened with jail if he didn't tell the "truth". I've always liked Clemens and I hope he is being truthful though I suspect he isn't...

My biggest problem with this is debacle is indicting players who were blindsided by this report. Many probably did take steroids and other growth supplements, but they weren't all illegal at the time. It isn't right to come back and smear them now...

I don't know what to believe on this front, honestly. Everytime I think someone is innocent they turn out guilty so it's hard to just give people a pass anymore.

As for the Government involvement...meh. To me, personally, there are FAR more important things our Government should be doing, and spending their time on, then catching cheaters and steroid uses in sports.

I actually agree. And yet if you look at it from the Gov't standpoint, professional sports are billionaire-dollar entities which the sales from their product are a huge contributor to the economy. If the integrity of that entity causes questions, it could very well affect the economy. And with the economy being what it is, it has to be a concern. It's a reach, but I could see why the gov't might want to take a looksee into such things.

I personally believe Clemens did it just like Bonds but it wasn't illegal in baseball then so who cares. It's a waste of time.

I have never liked Clemens. I think he was the biggest head hunter in baseball and should have been suspended during his career for his actions.

I will never forget watching the game where he almost killed Mike Piazza. I remember watching the first three batters and how he was throwing at them and told my wife that he is going to hit Piazza in the head. And then he almost killed him. He is INSANE> He is a punk bully coward that I hope Congress puts in jail right along with Barry Bonds.

as far as the trainer having the needes, I heard somebody say they can determine if the needles have been interfered with since they were used. I could care less about the trainer but hope like heck that Roger is exposed like the fraud he is.

I do believe that the trainer kept the needles and gauze etc in order to possibly blackmail Roidger if it was needed. That is just my opinion of course.

this past week it was revealed that the trainer also injected Clemens wife with HGH for a photo shoot. If that was the case, then why hasn't Roidger screamed to the presss in defense of his wife. All that has been said from his side is a statement from his attorneys stating that the case is about Roidger not his wife. Well if Roidger was a real man he would scream about somebody saying awful things about his wife. I guess Roidger is ok with that. He is a fraud. As big or bigger fraud that Barry Bonds. I hope all his records are eventually taken away from the co-biggest cheater of baseball.

I take it you never played much baseball. Pitching inside and intimidation is a big part of the game. You want to go after Bonds and Clemens I hope that makes you feel better. 75% of players in that era were on performance enhancers.

I know about pitching inside. I think Bob Gibson was as great of a pitcher as there was and he lived inside. But I never felt Gibsons intent was to mame like Clemens. I truly believe when he hit Piazza it was meant to hit him in the head. Not to pitch inside. Clemens could put a ball wherever he wanted to. Hit a guy in the back, in the butt, in the side, in the arm, in the leg, that is fine.. but to throw and hit a guy in the head, ON PURPOSE, the guy is scum....How about the bat throwing incident in the World Series? Roidger thought the ball was a ball and he just decided to throw it at Piazza. What a complete nutjob.

This is from Jose Canseco, who whether you like him or not has been dead on with regards to who is dirty and who isn't...

I can't remember whose house I was at last week much less 10 yrs ago. Other than a woman, Who has that good of recall? Women can remember things from two days after birth. And they won't forget stuff after they are dead either.....

He was a head hunter until he went to the NL and had to bat. He suddenly didn't hit as many batters as he used to.

It's part of the game. pitching up and in. The greats did and do it. Pedro and Clemens were brutal.

My son when age 11 with a live arm but a tad wild took a batter out inside later on ride home made a simple observation. After that nobody was digging in and he mowed them down.

It's a fine line between throwing up and in and trying to hurt someone. Clemens for sure pushed it some.

Why he won 250 games, he was a great pitcher pre and post steroid era.

Wow - If McNamee purjured himself here this could be very bad for him.

We just need to let this go, steroids and HGH not tested and illegal back then. And clean it up forward. He said she said - obviously this like in football was pervasive. Not sure why NFL gets a free pass.

Canseco has really been spot on here on this stuff. McNamee perjuring himself really puts him on thin ice.

Here's hoping that Roidger is escorted out the hearing tomorrow in a pair of handcuffs for perjury.

I saw tonight that the years in question are 97, 98, 91, and 04. If the runnerup to those years had actually won it, then Randy Johnson would have 7 Cy YOungs, and Pedro Martinez would have 4. I bet Roidger still sleeps well in his denial...

Canseco said 70% of MLB players were juiced.

You play god on who was and was not. In that era it was not tested.
