Meth addict accused in burglary sues 90-year-old homeowner shot in jaw

A 90-year-old California man who was shot during an alleged burglary has reportedly been sued by the admitted methamphetamine addict who allegedly shot him.

The Marin Independent Journal reports that Samuel Cutrufelli, 31, claims Jay Leone “negligently shot” him during a January confrontation inside Leone’s home in Greenbrae. Authorities have said Cutrufelli entered the home and put a gun to Leone’s head before binding the elderly man with a belt and rummaging through the residence for valuables.

Leone said he was able to wriggle his hands loose before convincing Cutrufelli to let him use the bathroom. He then grabbed one of the five handguns from his bedroom and spotted Cutrufelli in his closet. Cutrufelli, in turn, allegedly fired his gun, striking Leone in the jaw. Leone then fired back before Cutrufelli wrestled his gun away and put the gun to Leone’s head and pulled the trigger — but no bullets remained in the gun.

Both men were hospitalized for an extended period following the gun fight. Cutrufelli claims Leone caused him “great bodily injury, and other financial damage, including loss of Mr. Cutrufelli’s home, and also the dissolution of Mr. Cutrufelli’s marriage,” the newspaper reports.

If this guy has a lawyer. That lawyer should be immediately disbarred for being too stupid to be representing someone.

They won't do much about it although the wrong judge could slap them down. There is no penalty generally for submitting frivolous lawsuits in this country. The lawyers win no matter what and they make the rules.

We need tort reform in this country like Britain has but I don't see it happening.
 
This kind of thing drives me nuts. The fact that this is even considered speaks volumes about where we are as a society.
 
A nice headshot or even a couple of shots to center mass would have prevented a lawsuit being filed.

The part that was left out is the meth user had called Timeout before he was shot. :laugh2:

Honestly, you're better off killing the guy that breaks into your house this day in age. My neighbor is a cop, and he's always said if someone breaks into your house KILL THEM. Drag them back inside and stick a knife in their hand if you have to, but KILL them. I tend to agree. :D

Remember. There's a million mile difference between filing a law suit and winning a law suit.
 
And Canadian wonders why some people dislike some lawyers.

If you have to shoot someone, make damn sure they are dead.
