My Little Brother's Death

I posted last week about my little brother dieing, and I would be pulling for the Dolphins the rest of the season in his memory. I'd like to give the details of his death because it could happen to you or someone you love.

My brother Jeff was an addict his entire adult life, and spent most of that time in and out of Jail. He died on 10/26/2010 about 3 blocks west of the Ga Dome behind an abandoned house. When he first died we were told it looked like an accidental overdose, that there was no real trauma to him. Well they did the autopsy and we had his body shipped to Fl for the funeral. the day he arrived in FL my brothers and I went to see him, to see if he'd need a hair cut etc. what we found was well shocking to myself. He had numerous abrasions to his face, and 3 of the marks were indention into his skin, the same size, shape and roughly the same depth from looking at them. while 1 of the marks was vertical and the other two were horizontal I could tell they were caused from the same thing. I could also tell from the lack of bruising around the marks (one of which was near his left eye) that the injuries had to have occurred just before he died or right after. Well my brother and I went back the next day to take photos of the marks because they bothered me so much, it was totally inconsistent with what the M.E. had said.

Well yesterday I was able to get the Doctor who oversaw the autopsy (the actual autopsy was preformed by a medical student) on the phone and we were discussing the case, and he was going over his notes and the photos they took during the autopsy (all both of them) well he asked me to email him the photos we had taken, and he called me back and said "Mr Smith I'm very disturbed by these photos" he said he could tell the marks were sustained just before my brother died probably seconds before his heart stopped beating, and that he was most concerned with some bruising around his neck, he said and I quote "the bruising appears to be strangulation marks". My brother was not a small man, and would have fought tooth and nail which concerned the doctor there was no defensive wounds, but in another photo that we had showed a fist sized bruise on his Left Jaw in-between his go-tee and his left ear. I pointed this out to the doctor and asked him, if a person can be knocked unconscious if struck in that area with one blow (I knew the answer being a huge boxing fan) he said yes. the toxicology report won't be in for a couple more weeks, but the one that was done the day he died showed THC, and Opiates. So I asked the Doctor if a person that is "high" if they are knocked out, is there a chance they could stop breathing? he said yes there is, which would also allow a person to strangle them and there be no defensive wounds.

So why am I telling you all this? the reason why is because the M.E. was ready to rule it a drug overdose, when now they are leaning towards ruling it a homicide. The system as it is now does not care about drug addicts, and more often than not when a addict is found dead they rule it an overdose if drugs are found in their system. If you ever lose someone close to you and you have questions about it, don't let them push you away until you are satisfied with the evidence that they provide. I know that with the marks on my brother's face and neck they should have never been overlooked.

So my theory is he was doing drugs with someone, and for what ever reason the other person or persons struck him knocking him out, then strangled him.
The Girl who found his body called my sister when she found out we had been asking questions about the marks on his face and neck and said she was worried that when she found him she had tried to slap him to wake him up, when at the scene she told the police she had not touched the body.

My condolences to you and your family. A death is a death regardless of how they died via a drug overdose or a car accident there still people you loved, Its still a brother or sister who is gone. Its still painful, even after 30 plus years. Thank you for the info. *** Bless.

I didn't see the previous post you alluded too, but I am sorry to hear about your tragedy. My cousin's wife had drug issues and she died of an OD leaving behind two beautiful children. I thank you for sharing your story here with us.

RIP to your brother and I hope you are able to figure the rest of it out and put everything to rest. Including whoever did this to your brother.

I am sorry to hear this news Smitty. I hope that what you describe here is addressed in the proper fashion and that this thing gets closer for you and your family.

A sad story, no question. For what it's worth, sounds as if he is in a better place now.

That's a horrible story. I'm sorry to hear about your loss and the insult to injury of the agencies we trust blowing off a serious crime.

Good for you and your persistence. It won't bring your brother back, but hopefully you can get some peace knowing what really happened and getting it answered to.

Funny thing is, in my business. I've worked with people who had GEDs that were more competent than some people with Masters degrees in CS. I've seen people with masters degrees that I wouldn't have flipping burgers at McDonald's due to them being a fire hazard.

There are all types of people out there. Those than can, can't, then care, and don't care and all mixes in between. A formal education guarantees nothing.

Honestly it bothers me that 1. they only took two autopsy photo's, and 2. that a medical student was who actually preformed the autopsy. I'm fairly confident that the actual Doctor who's responsible would say he was there during the entire autopsy, but more than likely with the Atlanta case load I doubt he was.

I spoke with the detective who was on the scene the night my brother died, and he's been calling the M.E. daily to see what the status of the case is (meaning he wanted to know if it was ruled a homicide or not), which leads me to think he thought something was "fishy" from the start. I have also sent him the photos we took.

from the research I've done it's not uncommon for bruising to show up days after a person has died. So the bruise on his jaw, and neck could have been missed but like I said the marks on his face that drew my attention there is no way they should have been missed. if it weren't to graphic I'd post a pic of his face so you could see what I mean, but more than a few people may get weirded out seeing a photo of that.

Sad to say that this happens all too often. Given an 'obvious looking' situation, far too many times the easy way out gets taken.

"At some point in the history of heroin addiction, probably in the early 1940s, the custom arose among coroners and medical examiners of labeling as "heroin overdose" all deaths among heroin addicts the true cause of which could not be determined. These "overdose" determinations rested on only two findings: (1) that the victim was a heroin addict who "shot up" prior to his death; and (2) that there was no evidence of suicide, violence, infection, or other natural cause. 24 No evidence that the victim had taken a large dose was required to warrant a finding of death from overdose. This curious custom continues today. Thus, in common coroner and medical examiner parlance, "death from heroin overdose" is synonymous with "death from unknown causes after injecting heroin."

Jack, I didn't know about your brother's death. I must have missed where you shared that. I am sorry for your loss. I wish you luck in your search for answers. That's rough man. My brothers are both addicts and I've feared what you're going through for many years.

My hearfelt condolences to you and your family over your tragic loss.

I hope the persons responsible for this get their just due and your brother and family gain the justice and closure they deserve.
