NFLPA: No irreparable harm to NFL if Ezekiel Elliott plays during legal battle

The NFL Players Association says there would be no irreparable harm to the NFL if Dallas Cowboys running back Ezekiel Elliott continues to play while the legal battle over his six-game suspension makes its way through the courts.

The NFLPA made its argument through a legal filing Saturday with the 5th U.S. Circuit Court of Appeals in New Orleans, saying Elliott "stands to lose nearly half a season in a career that is notoriously short and precarious, and competitive opportunities are irretrievable once lost."

On Friday, the NFL asked the appeals court to overrule the Texas federal judge who granted a preliminary injunction of Elliott's suspension. The league is seeking a decision as early as Tuesday and as late as Sept. 26.

The NFLPA called the NFL's filing premature and reiterated its stance that the league's discipline process is unfair.

Not yet. The article simply reports that the NFLPA has made a court filing, responding to the NFL's filing yesterday if a motion to stay the injunction.

But I don't think anyone seriously doubts that we will this battle. As the NFLPA's filing suggests, the NFL simply can't establish that the injunction will cause it irreparable harm, which is one the things they must establish to get a stay of the injunction.

So Zeke will likely play all of 2017 and perhaps some or even all of 2018 while the NFL appeals Judge Mazzant's injunction in the 5th Circuit Court of Appeal. If the stay were granted, the NFL could require Zeke to serve the suspension immediately (even while the resolution of its appeal of Judge Mazzant's injunction remained outstanding).

Let's hope their argument about an NFL career being a short one does not really apply to their client in this case.

Not yet. This is just summarizing the NFLPA's legal brief responding to the NFL's appeal to drop the injunction that allows Zeke to keep playing while the substantive case makes its way through the trial court.

Interesting that the NFLPA filed this so quickly given that they had until 9/25 to respond. They must feel pretty confident about winning.

If I'm Zeke or the Cowboys, I wanna know sooner than later.

If they wait till the 25th and the stay is granted, he is out till thanksgiving right in the midst of prime playoff season.

FWIW...I don't remotely expect the stay to be granted.

Yeah, the Saturday filing by the NFLPA is basically taunting the league because they know the stay has zero shot of being granted. The league didn't even meet 3 of the 4 standards for an emergency stay.

It wouldn't shock me if the 5th circuit admonished the league for wasting its time with its own incredibly flimsy filing.

The NFLPA countered that irreparable harm would be instead to the player. The career of a player already is tenuously short, and a whole half season would be undue hardship upon the player.

This release by the NFL probably ticks me off the. Kat.

How can the NFL label anyone a domestic abuser and a domestic abuse victim when the judicial system did not?

The league could've just said "for a series of events, including the July incident, we suspend Zeke for 4 games for conduct detrimental to the league". Zeke would have nothing and would likely be serving his suspension right now and the league would would still look good for putting their foot down.

Instead they have to assassinate a 22 year old player's career marketability and threaten to bar them from the league based on evidence that has holes in it. The league should not have the right to assassinate a players character without concrete proof.

This is why Zeke is going to take this to the Supreme Court if need be...and the league has no one to blame but themselves.
