ESPN's Adam Schefter reports Josh Gordon will argue in his appeal hearing that his positive marijuana test was the result of second-hand smoke.
The news comes to light after it was revealed that Gordon's positive test was barely above the NFL's strict threshold. Gordon would have tested negative for marijuana in Major League Baseball, the Olympics and even the federal government. It shines a light on just how odious the NFL's marijuana policy is. He would've tested negative according to the Olympics and federal government standards.... The NFL is so weird....

He should have his ban increased for bringing a poor excuse to the table. It doesn't matter that his positive test was barely above the standard. It was above the standard. It also doesn't matter if the standards are lower in other sports. The players help make part of the standard when they collectively bargain with the league. If they wanted a lower standard then they should have fought for that in the past. Perhaps they will in the future, but for now the standard is the standard and he failed.

I think the bigger issue is the discrepancy between samples. One under and the other just over. I don't think he should go with secondhand smoke. The league doesn't care if a player ingested a tainted supplement, why would they ease up on a guy who unintentionally inhaled weed?

Given appropriate lab technique the two samples should be identical. The units of measurement are so small, and the samples are so small that a fraction of a drop could throw the numbers off. I'm actually shocked a 1/2 result would be positive because the B sample is usually considered confirmatory test of A and if the result don't match how can you say it's positive?

I'm also shocked that the NFL doesn't go by the federal cutoff (which I believe is 50 ng/mL) when enforcing a federal law.

Also, I'm not entirely sure but I think if the first sample comes back negative they don't even test the second sample. A negative on the A sample is generally considered good enough to conclude that the sample is negative. Positive results require a confirmation test. Had his B sample been tested first they probably wouldn't even test the second sample and he never would have came back positive.

I don't see how the suspension can be upheld given a 1/2. It would not shock me if he won the appeal, but I doubt the league is all that concerned.

If you want a conspiracy, the NFL has contrived the test results as a means to excuse his test just so they can take some of the heat off for the Ray Rice ruling.

Not that I have a an issue with pot, but dude don't be stupid! You're giving pot advocates a bad name. Just own up the fact you broke the league policy and move on. You should be smart enough to know and understand that you are at risk to lose millions.

even if he somehow beats the pot charge, he still has that DUI. He is toast.

Who is the last player suspended for a DUI? I honestly can't remember. Off the top of my head I can think of about 5 players who have had a DUI in hte last 3 seasons and none of them have been suspended.

Doubtful many have already served a suspension for substance abuse.

I dunno if he will or won't but his priors don't help him any.

The 15 ng/ml was the limit used by the World Anti-Doping Agency(WADA) for years. It made sense for the NFL to have the same standard as the agency that covers the Olympics. WADA raised the limit to 150 ng/ml last July(2013). The NFL will probably follow this lead, but I think it has to be collectively bargained.
