Its called an accident because thats what it is. Im sure youve never made mistakes huh.... Let the system take the situation over.

Its unfortunate the victim died. Moral of the story? Dont just jump in the middle of the street hoping cars will just stop. Use the crosswalk. Its there for a reason. Perhaps Darwinism in action?

What if Stallworth slamming on the breaks would of caused a pile up? Who knows how many cars or how close behind they were.....

alcohol impairs judgement, Stallworth thought by flashing his lights the pedestrian would move out of the way

he didn't, probably didn't have enough time to

If I see a person in the middle of the road regardless if there are cars behind me im going to hit my brakes. I doubt there was that much traffic anyways didnt this happen really early in the AM?

And if this pile up killed a driver instead of a pedestrian everyone on the board would be screaming about him causing the pileup that caused the death of the driver(s). Also who in the hell runs on the highway?? Was he trying to literally catch the bus or what?

Best to wait for all the facts to come out, but if he was driving drunk then the blame should fall on him. How do you know there were even vehicles behind him to cause a pileup?

That is the best thing and yes if he was wasted most of the blame should be put on him.

Hitting somebody from behind is almost always the fault of the person in the rear.

It doesn't change the FACT that he SHOULD NOT have been DRIVING a car.

Over the limit is over the limit.

Nowhere is it written that you can be just above the limit and not break the law.

I'm not arguing with that -- but the fact also is that he hit a pedestrian who was crossing where he shouldn't have -- and that point does have sway with jurors which is likely why he'll get a deal for a light sentence.

Those pictures look like a highway, but there is also talk of a crosswalk, so I'm a bit confused.

50 mph in a 40 isn't so bad.

Maybe Stallworth flashed his highbeams to get a better view of something that didn't look right (i.e., a man in the middle of the road), rather than flashing his lights as a warning. (EDIT: Opps .. bad theory for a daylight accident!)

His alcohol level is the most important number here, obviously.

Im not condoning this by any means, and Im not familiar with the area, but that looks like an interstate to me. WTH is a pedestrian doing on the interstate?

and any decent prosecutor is going to exploit the fact that he was under the influence

this isn't going to a jury trial, for that fact alone, I don't think his defense team is going to want to chance raising the jury's emotions

most likely he's going to take a plea, at least no contest

There is usually a couple a guys a year that get killed trying to cross I-45 into Houston. Its insane, there really is no way to expect to get across without someone hitting you at 50-60 miles an hour.

Still doesnt give him the excuse to drive drunk and 10 mph over the limit to boot. When you drive ALWAYS EXPECT THE UNEXPECTED! You cant do that if your DUI.
