Two more trying to sue EA

July 1, 2009 - It was announced on mycentraljersey.com that an ex-Rutgers quarterback is suing EA Sports for allegedly using his likeness without his authorization in their NCAA Football videogame. Ryan Hart, the QB from Rutgers, is being joined in his lawsuit by Troy Taylor who played ball at the University of California.

Hart and Taylor are saying that the use of the likenesses was an "invasion of their privacy for commercial purpose" and are also accusing Electronic Arts of "unjust enrichment."

"EA (Electronic Arts), the NCAA and CLC (Collegiate Licensing Company) have reviewed the complaint, and do not believe that the claims have merit," said Rob Semsey, senior public relations manager for EA Sports. "EA, the NCAA and CLC regularly conduct reviews of EA's NCAA-branded games, and we do not believe that any violations of student-athlete rights or NCAA bylaws have occurred."

The suit is seeking a jury trial and unspecified damages.

They have a good case. All professional athletes get paid for their likeness being used in video games. They try to get around it by not putting the names of the players in the games, but you can tell who all of them are.
 
They have a valid point. The NCAA is to blame though, not EA. They consistently make huge money off these guys and they get nothing in return.

Listen, I'm one of those people who says college athletes need not get paid for playing, as they get plenty of other perks.

But it's quite different when they make money off using your likeness in a video game and you get nothing for it. Nowhere is there an agreement that they're allowed to use your likeness to make money.
