The law in Texas is that misdemeanor DUI's in other states do not count as prior offenses under Texas' law. Based on what I read, Brent's previous charge was a misdemeanor.

Brent will be viewed as a first time offender. And first time offenders can usually avoid jail time.

I'd be really surprised if he avoids prison.

I'm not guessing that he gets years and years, but they are not going easy on a Cowboy.
 
Yeah I don't understand why anyone would be upset by this. Hilarious how people can get so bent out of shape when someone negligently kills another person.
 
Is the DUI the issue or is the Intoxicated Vehicular Manslaughter charge the issue?

He specifically is saying first time offenders in Texas don't always face jail and he cited a case he was on where the guy had priors in other states.
 
yeah I think he isn't being charged with DUI but with intoxicated manslaughter

highly doubt it. i think brown's family is going to support him in the trial.
 
The question on prison or probation will come down to if he is likely to continue the behavior and if he is still a risk. If found guilty then the first DWI can be introduced as an indicator of possible future behavior.
 
He'll do time, anywhere from 5 to 10 years. If he was being tried in Bexar County, he would be guaranteed 10 years.....

I think getting into an accident and killing co passenger (who was not forced) and running down people ( good Samaritans ) in the road are two different things.
 
I would like to point out the attorney whom I quoted did say "usually."

He did not guarantee he would avoid it.
 
He will get out with probation and have a strict set of rules around him saying if he screws up in any manner he will be going to the slammer. I would imagine it would be hard for them to try to issue major jail time if Brown's mom stands beside him.

I am not here to judge to say he needs to go to jail or doesn't. The one thing that needs to be made sure of is that it doesn't happen again. The man needs to go through some major counseling sessions and his team needs to be his backbone.
 
For the record, he thinks Brent will get 120 days, and he breaks down exactly why.

DUI is the least of his concerns. Intoxicated vehicular manslaughter is his real problem.

According to the attorney Norm Hitzges always has on for these things, he said he's looking at a 10-year sentence, which can be reduced with good behavior.

Bogus. I did some research when I first found out on that Sat and there was kid in TX who had the same charge, but the deceased was an innocent man he hit head on. The kid had previous alcohol related arrests (non driving) and he got 0 jail time. Just 8 years probation. I expect Brent to get 1-2 years. Browns family support is just about negated by the fact that he's "famous" and will be made example of, but a 10 year sentence would be ridiculous. There are murders (2nd degree) who've gotten less
