Why do Women commonly get the house in divorces?

I've always wondered this and I know there are a few people involved in law on the CZ. It doesn't make sense to me, especially in cases where the males are the breadwinner why the male is forced to moveout of the house most often.

I'm no lawyer and I'm kind of guessing, but I don't know if it's still that way, with more women working than ever. But I'm under the impression it was so in the past because the woman stayed home for the children and had no income. Therefore she should be compensated for that sacrifice. Being out of the work place for an extended period of time is an extreme disadvantage.

I practice family law. Women are more tied to their houses, they are nesters. They usually want to remain in the house for the children and buy the husband out or trade other assets for it.

Feminized legislation and places like safe place and other feminist, male-hating organizations have a huge part in this. If you have a ***** in 2011, the law isn't necessarily on your side anymore. That's just putting it lightly.

If you're splitting your assets generally a man would rather keep his savings, car, etc., and move out. After all, if he stays in the house who is going to clean it? :laugh2: I kid, I kid.

Na I meant to make this thread a few months back but then I just didn't and today while watching Breaking Bad Walter moved out and Skylar got the house, which triggered me to make the thread.

Obviously a lot has to do with who keeps the kids, if there are any, which is typically the wife. Also there is the old notion that the wife is going to have a harder time affording a new place to live because she is less likely to have the income that a man does (or any income at all), which is less true today, but still at least somewhat true. Still, the bottom line is that assets are supposed to be split equitably, so even if the man doesn't get the house, he should get enough of the assets that he can afford a place as well as the wife. I believe in cases where the biggest share of the assets are tied up in the house the house is sold and the money divided.

Alimony is a more difficult issue.

Don't feel too sorry for them. Most of the time, they'll be bought out of their share in the equity if there is any. Then there are plenty of times when the woman can't afford to stay in it, and the man gets to keep it. When that happens the woman gets paid out of the equity.

Of course, this is all under the commonly held belief that women always win contested custody cases unless they're crack heads. It's getting closer to an even chance on custody cases all the time.

I got my kid and kept my house and retirement. It's really how you go about handling the divorce from the start.

Which county or state are you practicing in?
