The NFL has made significant changes to the Rooney Rule since 2020, including redefining “diversity” and broadening the positions subject to the Rule.38 However, the Rule’s most significant evolu- tion was the NFL’s adoption of 2020 Resolution JC-2A (“Res. JC-2A”), which rewards draft picks to teams that develop diverse candidates into leading candidates that become HCs and GMs.39 The NFL mod- ified the compensatory pick system, which traditionally compensates teams for players lost in free agency, in order to reward teams for the advancement of diverse candidates under Res. JC-2A.40 Despite the additions of these rules, the unfortunate reality once again is that their efficacy is varied.41 For example, the San Francisco 49ers have demonstrated the team-side benefits of Res. JC-2A, as the team has received twelve compensatory picks after helping two diverse GMs and three diverse HCs find employment with other teams since 2020
