Another factor at play in Smith's decision on whether to appeal or not...

As of now, the 49ers' 2 biggest games of the season are their 2 games vs Seattle. They don't play Seattle until late November.

So if he doesn't appeal, he'll be reinstated a few weeks before they play Seattle. If he does appeal, there's a chance the delay in his having to serve the 9 games could cause him to miss the first Seattle game.
