when you look at the vast majority of appeals when a death sentence comes up virtually none of them are about whether there was doubt about guilt or a reason to commute the sentence. It is techincal crap that means nothing. Like the horrible 'fruit of the poisonous tree' ruling by the Supreme Court in the 70's where all evidence can be thrown out if you misspell a word on the search warrant. Does not matter if the search warrant was correctly done (i.e. what was searched was what the judge authorized) thousands of criminals have been freed over the years to victimize other innocents.
