With the baggage Aldon Smith and Von Miller are already bringing to the table this early in their careers, it makes you really appreciate how special Demarcus Ware is on and off the field. The only time he's been in the headlines off the field is when he and his wife adopted an orphan.

I think Von Miller is lucky he's going to play this year.

He failed a test and also worked with a specimen collector to alter his sample, or so I have read.

You can't have people trying to beat the testing program. They probably should have made an example out of him to discourage people from trying in the future.

The way I heard it explained while watching the various sports networks is that he hasn't been suspended by the 49ers. He is on a leave of absence from the team while he goes to rehab.

Dui, car crash, possession of marijuana and pills were found. Also i think its his 2nd dui in a short period of time

Is that required for him to be suspended by his employer?

I guess not since he's suspended, but I just think it's a bit extreme to say he never should've played today, when the incident happened like 36 hours before kickoff

He's not suspended. The timing is irrelevant. It is just a matter if they think he did it, which I don't think is questionable and whether they think it was enough to warrant a suspension. They also could have taken the step to just leave him off the game day roster without a suspension.

To me it is. There's usually a process the league follows, except special circumstances (like Josh Brent). Aldon Smith broke the law, committing two misdemeanors and typically players are suspended after the legal system is finished with them. So considering this occurred on Friday, I don't think it was wrong for him to play on Sunday. I actually applaud the 49ers for making him go to rehab, since I don't at all think it's voluntary (what do voluntary mean...couldn't help it)

It isn't as if the 49ers have much of a choice. They have to do something with him or risk seeing him get suspended by the league eventually.

I think this incident could have very well be considered a special circumstance. There is no doubt at all that he was drunk. And this isn't his first incident. It wasn't a situation that he "should" have been suspended by the 49ers, but I don't think they would have taken much blow back from the league or the NFLPA if they did choose to suspend him for this game. And don't get me wrong, I am not saying he definitely should have been suspended. I just don't think the timing of the incident matters. It could have been on Monday or on Friday. If the team thought he should be suspended, then it doesn't matter what day it happened.

Reports are when the police arrived at the scene he was passed out behind the wheel. The only thing that kept this from being a Josh Brent situation is blind luck. 49ers are just trying to get his punishment out of the way now while they are still in the early part of the season. Harbaugh would play him every week if he could. He doesn't give a crap.

this was not a guy that has a clean record. So there is no excuse for the Whiners to not act as they SHOULD have. Either suspend him or put him on inactive.

36 hours was more than enough to understand what had happened.

Apparently he's got a major issue that goes beyond even that stupidity Friday morning when he was arrested. But I'm sure it's not his fault right? No big deal? He's just driving while intoxicated at 7 am and wrecking his vehicle. I'm sure there will be plenty of people that will think this isn't a big deal.

look at how many thought Rat's DUI just weeks after Brent was no big deal. He didn't kill anyone.

There was some sort of rule on why he couldn't be suspended from the game today, I forget what it was.

Either way he is toast for a while.

They easily could have deactivated him, but chose not to.

Disgraceful, IMO.

I'm glad he's seeking help, and good luck to him down the road, but he should go to jail as well. 2 DUI's? Seriously?

He did. Which was pathetic.

Just goes to show you. Teams won't make an example out of you if you have talent and can help them get wins. If he was a backup or practice squad player, he would have been cut that very morning.
