Concealed Handgun Gun in Texas

I have called "supposed" authorities on this matter, including TDPS and I cannot get an answer to this question.

Do I need a Concealed Handgun License to have a gun that will be used for Home Defense?

It seems like a simple question because it will aways be at home but my main concern is if a Cop will ask me for a license if I am on my way home from buying the gun or on my way to a gun range and I get pulled over for a basic violation.

DPS told me to call a local police station, so I will do that at some point.

I wouldn't know for sure but it would probably be a good idea just to cover your assets so to speak. :laugh2:

Not in the State of Texas... you'll be fine...

And should a cop pull you over, just show him your receipt after picking up the gun following your 3 day wait. If you want to be doubly sure, put it in your trunk for the drive home...

Thanks for responding Trickblue.

When I spoke with the lady at DPS, she said that Texas was not an "open carry" state and that when the gun is in the car, it has to be concealed.

So say I am going to the gun range, the gun is in my trunk as you said to do and I get stopped and the officer asks me if I have a gun in the car.

I am sure I tell him yes but will he then ask me if I have a license for the gun?

I just don't want to go to jail but I don't want to spend money taking classes just to get a gun that will be in my house 99.9% of the time either.

As long as you have the receipt showing that you picked up the gun that day you are fine. Just make sure that they cannot say you are taking the long way home.

Sounds like he is not just worried about going home after buying the gun.

He is also asking if he needs a special license to take the gun from home to the range and then back home on occasions.

Every state is different regarding guns in a car Mike. You are in Texas, so the gun must be concealed. In Virginia it must be in plain sight.

It makes sense to get a Concealed Weapon License whether you will ever use it or not. It protects you every single time from frivolous actions. You need a license for each firearm you may have on your person. I recommend the License because you have to qualify with the weapon to earn the License and that means you respect the gun.

First thing to do whenever placing a gun in the car, always put it on Safety. Small thing, but it sends a message that you are safe to anyone who questions your intent.

If you have a "secure" holster, meaning one with a snap that keeps the hammer in place so the weapon cannot fire, that is yet another indicator for an Officer that the gun is not a threat. In fact, I recommend a holster at all times rather than a free weapon any time you are in a car or not. It is easy for a lawyer to defend you if you do run afoul of an Officer. Even if the gun is loaded. Another reason I do is because sweat and body oils are bad for the gun. The holster protects the gun too.

To answer your question though, when I travel somewhere to a range with a gun that I do not have a License for I unload the gun before I ever take it to the car.

If it is a pistol with a magazine I remove the magazine and I slide the receiver open if I don't have a holster for it. I holster it if I do, and secure the hammer. If you can keep the receiver open and in the holster do it. This shows an officer that the gun does not have a round in the chamber, and is not in the car to be used in the act of a crime.

It is better to put the gun in a protective case in the trunk and the ammunition in the glove box. The simple explanation for the gun being in a case in the trunk is that it is out of reach for a driver or passenger. No wrong intent can be assumed.

If it is a revolver I unload the wheel and either leave it flipped open if it does so, or in a secure holster. Bullets in the glove box.

If you ever put the pistol in the glove box rather than a case in the trunk, unload it and lock the Glove box. It speaks to intent again.

No officer will ever mistake your intent if you do these things, or if they do you will win any fight for your rights.

One last thing, never, and I mean never, have one in the car if you have been drinking. I don't mean drunk either. I mean drinking. Alcohol, firearms, and driving equals extreme paranoia.

Hostile, thanks for the information as usual.

I am still doing some research, so I don't know whether I am going with a Shotgun or a Handgun.

My primary concern was making sure I know all my rights and responsibilities before purchasing a weapon.

There is a gun range near my house and I will probably go there first before purchasing a weapon.

I am looking at everything from ease of use and how easy the weapon is the clean.

No. If you carry a gun on your person you must have a license to carry it. However the old gun laws still hold true. Home protection, traveling you can posses a fire arm in your car however there are rules about it being loaded.

No you do not.

You DO NOT need a license as long as you are home,traveling, the gun isn't out in the open, you are not a gang member and not committing another crime.
Do a web search for Texas Gun Laws and you can read more about it.
If you have a CHL then none of the above applies.

Of course not with all the drug related kidnappings in Arz it should be mandatory to carry a gun. :laugh2:

you dont need to have the receipt, you can have a loaded fire arm in your vehicle as long as its concealed. You don't need to have a conceal and carry license to do that. The only time you'd need a conceal and carry permit...is if you are toting it around town.

I believe it was 2007 when they changed the law so you can have a fire arm in your vehicle without having a permit (God Bless Texas)

Also, FYI, you should look up the Taurus Judge pistol...its a 5 shooter pistol, but it can fire a .45cal round and a 410 shotgun shell, makes great for home defense...pepper'em once with the shotgun round...finish the job with some love and your .45!

I'd buy a Gatling gun like in Terminator. You can tear up a bunch of cop cars if need be.
