Sec. 46.02. UNLAWFUL CARRYING WEAPONS.

(a) A person commits an offense if the person intentionally, knowingly, or recklessly carries on or about his or her person a handgun, illegal knife, or club if the person is not:
(1) on the person's own premises or premises under the person's control; or
(2) inside of or directly en route to a motor vehicle that is owned by the person or under the person's control.

(a-1) A person commits an offense if the person intentionally, knowingly, or recklessly carries on or about his or her person a handgun in a motor vehicle that is owned by the person or under the person's control at any time in which:
(1) the handgun is in plain view; or
(2) the person is:
(A) engaged in criminal activity, other than a Class C misdemeanor that is a violation of a law or ordinance regulating traffic;
(B) prohibited by law from possessing a firearm; or
(C) a member of a criminal street gang, as defined by Section 71.01.


(a-2) For purposes of this section, "premises" includes real property and a recreational vehicle that is being used as living quarters, regardless of whether that use is temporary or permanent. In this subsection, "recreational vehicle" means a motor vehicle primarily designed as temporary living quarters or a vehicle that contains temporary living quarters and is designed to be towed by a motor vehicle. The term includes a travel trailer, camping trailer, truck camper, motor home, and horse trailer with living quarters.
(b) Except as provided by Subsection (c), an offense under this section is a Class A misdemeanor.
(c) An offense under this section is a felony of the third degree if the offense is committed on any premises licensed or issued a permit by this state for the sale of alcoholic beverages.

I am still doing some research, so I don't know whether I am going with a Shotgun or a Handgun.

My primary concern was making sure I know all my rights and responsibilities before purchasing a weapon.

There is a gun range near my house and I will probably go there first before purchasing a weapon.

I am looking at everything from ease of use and how easy the weapon is the clean.
Get both. A loaded shotgun for the house and a handgun for yourself.

Problem solved.

It seems like a simple question because it will aways be at home but my main concern is if a Cop will ask me for a license if I am on my way home from buying the gun or on my way to a gun range and I get pulled over for a basic violation.

DPS told me to call a local police station, so I will do that at some point.

Mick, I think that you have gotten great advice so far. One thing I would like to add is that if you were to be pulled over for a traffic violation, you are not subject to a full search of your car without due cause. If the officer asked you if you have a gun if you were stopped for speeding, you would not have to tell him that there is one in the trunk. However, you need to get a license to own the gun, that is required. Just go ahead and get the license and ask your local police office what your rules are, and be very careful with the gun.

You DO NOT need a license to own a hand gun or long gun in the state of Texas. (This is a free state) ;)

You DO NEED a CHL (Concealed hand gun License) to carry a handgun on your person.

You DO NOT need a license to carry a hand gun in your vrhicle in Texas. BUT it must be concealed. If the police stop you and ask, DO NOT LIE to the officer.

You DO NOT need any type of license to carry a long gun in your vehicle, and it does NOT have to be concealed.

When pulled over by the police. You ARE required to tell the officer you are a CHL holder and present the license.

If you have a sedan type vehicle not a SUV, its always best to keep it unloaded in the trunk. As long as that is done, no one can say anything. Well, outside of the peoples republic of strange like NJ, and some other places like that.

You absolutely do not need a CHL to have a gun in your house. You can walk around your house all day with the thing tucked in your undies, or in your hand. If you're in YOUR house, you can do whatever you want.

As far as traveling with it to and from the gun range, you don't need a reciept, or any of that garbage, you need to have it in a carrying case (most guns come with a case when you buy them), and you need to have it WHERE YOU CAN"T REACH IT WHILE DRIVING WITHOUT COMING TO A STOP. In other words, put it in the trunk, or the back of your SUV. DO NOT have it loaded, and put the ammo IN ANOTHER PART OF THE VEHICLE while transporting.

If you are just looking for home defense, without question, you want a shotgun. And a pump shotgun at that.

There isn't a human on earth who doesn't know the sound a pump shotgun makes when you pump it.

Imagine laying in bed, and you hear a noise coming from the living room. You grab your shotgun that is under the bed and make the "pump" action in a queit house at night. Whoever is out there, will RUN to the nearest exit.

Handguns are a whole other game entirely, and they are difficult to use properly in a dark house, when you're half asleep, and you think there is a stanger out lurking.

A shotgun is simple, noisy, and highly effective. Plus, a pump action shotgun is CHEAP.

Unless you "want" to have handguns. Stick with the shotgun 99.9% of the time. They are much more effective, and if you do have to pull the trigger one day, you won't miss like you will in a high pressure scenario with a handgun.

But like I said, and I can't stress this enough, the mere SOUND of the shotgun pumping will make any intruders bolt out the back door immedietly 99.9% of the time before you ever ever see them.
