I don't think so. When you're suspended, they withhold your pay during that time. There's a max the team can suspend him, but they can do it.

OK Thanks. I thought they just got fined.

I don't think the Cowboys have grounds for suspending Orton if he shows up at training camp and participates.

Well employers can manufacture all sorts of grounds for suspension. If he's participating, but being a distraction in some sort of way. They won't need much to prove, because they got his offseason actions as groundwork.

I'd look at how Denver handled Jake Plummer. I think there was a compromise there where Jake cut them a check and everyone moved on.

On March 3, 2007, Plummer was traded to the Tampa Bay Buccaneers for a 2008 conditional draft pick. However, rumors began to surface that Plummer was going to choose retirement over competition with the Buccaneers' four other quarterbacks on the roster (Bruce Gradkowski, Tim Rattay, Jeff Garcia, and Luke McCown).[11] On March 9, Plummer ended the speculation by announcing his decision to retire.[8] Plummer also confirmed his retirement through the Jake Plummer Foundation's website.[12]

Since he was still under contract to the Buccaneers and had already been given his contract signing bonus, Tampa Bay coach Jon Gruden met with Plummer in July to try to convince him to reconsider and report for training camp.[8][13] However, the attempt was unsuccessful and the team sued for recovery of the bonus. A settlement was finally reached on June 10, 2008 in which Plummer was required to pay back $3.5 million to the Buccaneers.[14]
If Orton follows the path the Plummer took, then he would pay back the money or try to negotiate a compromise amount.

It becomes a different issue if Orton reports to training camp.

I can see where Orton would have a legit argument that he should only owe about 1.6M and not 3M. They added 2 extra voidable years to his contract to stretch out the bonus, but they contract was really a 3 year deal. If he played all 3 years then he would have received the entire 5M bonus when the voidable years were voided. That would leave 1/3 of 5M or about 1.6M instead of 3/5 of 5M which is the 3M number.

I think it's going to be significant tho... it has to be more than a slap on the wrist or else no one will take it seriously.
