Fans should know CBA rules for contract negotiations

How does Jerry continue to fool the fans with this phony soap opera? None of this is real. He has said repeatedly he wants the cowboys to be a year long soap opera. This is just part of the show. Quit falling for it
I need you to tag me on the day the contract gets done!! I'm simply waiting for it to happen we know it will happen lol

Many fans saw the appearance of Jerry Jones on Michael Irvin’s podcast today. Saying he had “an offer on the table for Micah Parsons” with sizeable numbers.

JJ saying all that is a total waste of time and a complete misrepresentation of how NFL contract negotiations are to be conducted according to the NFL’s current Collective Bargaining Agreement (CBA)

For example, if an NFL player has an NFLPA-certified agent, (which Parson’s agent David Mulugheta certainly is) then all negotiations must go through that agent. Period. Teams are forbidden from contacting or negotiating with players who are represented by an agent without the agent's presence.

Jerry knows this! Clubs can face penalties for violating this rule, including the cancellation of any contract offer or signed contract made outside of these rules. This rule protects players by ensuring they are represented by their agent during negotiations, helping to prevent situations where a team might pressure a player into a less favorable deal without their agent present. (Imagine that)

So if we hear Jerry or Stephen say that “we had an agreement last March”, it is a completely invalid argument. Apparently meant to win in the court of public opinion in hopes that many Cowboys fans should buy that. Don’t buy it. It’s invalid.
Where did you get your JD Bob? Is this your interpretation or what is actually in the bargaining agreement. I don’t see any links to back up your statement.

Tagging Parsons will be a huge mistake. If they won’t pay him market value, trade him. I think JJ knows he’s botched this and is clumsily trying to save face. It’s isn’t working.
Parsons doesn't want 'market value', he wants to be the 2nd highest paid player in NFL history, right behind #4.

And the last part? Jerry hasn't botched anything, I believe a deal is already in place and him and Micah are just milking the whole drama for attention.

My thoughts are this:

1. Yes, a GM can have talks with a player in regards to a contract if the player is willing and is in good faith
2. We don't know the exact specifics of their talks, and if Parsons was actually negotiating with Jerry or was just general with the added phrase of *"lets get David involved to hammer out the details"
3. If Parsons from the get go wanted David to fine tune it, then Jerry is being disingenuous. He can say he offered X amount or Y guaranteed, but unless the contract was written and ready for signature/review it means nothing. Not to say they would lie about numbers, but remember they tried to throw in the clause about guarantee forfeiture on Gregory's deal in the last hour.
4. This whole thing just stinks. Either egos or just a big ruse to hype up Cowboys talk at the expense of the team/training camp. Jerry may not care for certain agents, but I would find it hard to believe, even at his age, he would truly think he could bypass an agent of David's magnitude and/or just shutdown talks for the entire summer once Parsons didn't "sign" his verbal conversation.

Alienating our best player in, what 20 years?, is a bad idea on so many levels.

If that ever was the case just what are you going to do on site? Naw, just full of your self.

You must not know how to ask the Justice Department to just fire Jerry. Oh such a football smartie.

"My job is managing the check. Micah's got to do the playing. Where's the least important part of this whole equation we're talking about? What is the least incremental part of the whole equation? The attorney, or the agent. He works for Micah. He's not the principle here, in any way."

The agent is not the center feature in this projected contract! Jerry will get his way, and legally. Never has been any other way for that man.

"[Irvin] and I would tell them we could do some pretty good business without an agent sitting there. As you well know, I've done most of my negotiating without an agent in the room."

Jerry knows this well:

His stat line—52.5 sacks, 256 combined tackles, and nine forced fumbles—already rivals seasoned veterans, but what’s most impressive is his effect on Dallas’s win rate.

  • With Parsons active: Cowboys are 41-23 (.671 win percentage)
  • Without Parsons: Cowboys fall to 1-1 (.500 win percentage)
That’s a massive 15.1% swing in win rate, proving Parsons isn’t just a stat-stuffer; he directly determines outcomes.

There is no contract. That has to be reviewed by both the NFL and Player's Association.

You attempt to make an issue out of nothing here. A contract has to be signed first. All else moved from that point.

The legal team for the Dallas Franchise does not blow these items.

One has to also put his pants on before going outside as well...I don't care how many crumpled calendars are thrown about.

Get him signed and Parsons is dependent upon Jerry, for the record. A correct contract is not an issue.

At issue now, the three most important players on the team getting workable and top level contracts:

QB top contract
WR top contract
DE negotiations of top level contract

What is not being considered are contracts like for OG Smith and room to handle a current season.

Try and get more sleep ... yourself. Or just stay off insults. You really aren't impressive yourself. :flagwave:
Aaaaaaaand…. Ignored lol

Have fun talking yourself around in circles— but you can do it by yourself.

Bob,
Where do you see that language in the CBA?

.....

This is what the CBA says:

“Under procedures to be established by agreement between the NFL and the NFLPA, the Commissioner shall disapprove any NFL Player Contract(s) between a player and a Club unless such player; (a) is represented in the negotiations with respect to such NFL Player Contract(s) by an agent or representative duly certified by the NFLPA in accordance with the NFLPA agent regulation system and authorized to represent him; OR (emphasis mine) (b) acts on his own behalf in negotiating such NFL Player Contract(s).”

[Article 48 Section 2](https://overthecap.com/collective-bargaining-agreement/article/48#google_vignette)

The language in the CBA is only to ensure that an agent is certified by the NFLPA. But no where does it say that if a player has a certified agent they can’t still act on their own behalf. It’s just if they have an agent it must be a certified one. It’s directed at like the Lamar Jackson Saint Omni stuff if you remember that.

In section 3 under penalties they only reference what happens if a team negotiates with an uncertified agent.

“Under procedures to be established by agreement between the NFL and the NFLPA, the NFL shall impose a fine of $47,000 upon any Club that negotiates any NFL Player Contract(s) with an agent or representative not certified by the NFLPA”

Excellent observation.

Yes, part of Jerry Jones persona is disturbingly like that of a politician. Use deception and mis-characterized the circumstances in order to sway public opinion.
And use the media to gaslight the public/fans

I thought this rule existed to protect the agent from losing his piece of the pie and to protect the player from having the small print screw him. I the past we have often heard about Jerry and other gm’s finally meeting with a player to clear the air and set some parameters. I thought this was okay as long as the agent comes into the process to read the contract and advise the player prior to signing.

I don’t know, but I’ve certainly read that Jerry has often sat down face to face with players when negotiations were stalled. Is all of that not true?

Actually it’s between the NFL and the NFLPA. Not the franchise owner and the player. The owners have agreed their interests are represented collectively. The players have agreed they are represented by a union. Micah does not have a legal right to go outside the union and make a player compensation deal. Jerry Jones, and the other owners, have agreed to recognize the NFLPA as the sole legal representatives of NFL players for all employment issues.
Sorry, this is just wrong. Jerry and Micah are the principals here. Yes, they've agreed legally to play by certain rules, but Jerry didn't break any CBA rules here, and neither did Micah. What they talked about amongst themselves on didn't constitute a formal contract.

If Jerry had gotten him to sign a contract when his agent wasn't there (and Micah wasn't acting as his own agent, which he isn't here), then it wouldn't be enforceable under the CBA. But that's not the situation here.

You haven't discussed a thing and still reveal ignorance. The US is the world's highest user of cocaine.

I never have had a problem with drugs or alcohol...but am not naive in useage of their complications. You giggle...

How you can afford to pay attention with three players at a $100M+ demand on team structure.

Go on back to your drugs...

Explain how the team also signs OG Smith now also....can you? Use English as your excuse now!
This is so confusing

I find great humor in these pointless arguments. I mean, Fans and posters taking sides in this as if their opinion has any effect at all on the outcome. Resorting to anger, name-calling and blocking posters over something fans can't influence is silly.

I think we should all step back and let the chips fall where they will. This "soap opera" will soon be over.

Micah is not Randy White he's not Bob Lilly he's not Charles Haley he is nothing but small when it matters.
No he's not! He is one man who has no help like those stacked defenses had. Parsons is as good as any of those guys.

Please cite to that provision in the CBA.
https://overthecap.com/collective-bargaining-agreement/article/48

The NFL and the Clubs recognize that, pursuant to federal labor law, the NFLPA will regulate the conduct of agents who represent players in individual contract negotiations with Clubs. On or after the date on which the NFLPA notifies the NFL that an agent regulation system is in effect and provides the NFL with a list of the NFLPA-certified agents, Clubs are prohibited from engaging in individual contract negotiations with any agent who is not listed by the NFLPA as being duly certified by the NFLPA in accordance with its role as exclusive bargaining agent for NFL players. The NFLPA shall provide and publish a list of agents who are currently certified in accordance with its agent regulation system, and shall notify the NFL and the Clubs of any deletions or additions to the list pursuant to its procedures...

There is more to it than the I pasted. The link lists enforcement and penalties. In order to represent yourself you have to file to do so. Micah has not so therefore he is not listed as a certified agent by the NFLPA.

Completely, totally unethical of him to negotiate without the agent present. Slimy and underhanded are other words that come to mind.

What a ridiculous opinion, when agents and lawyers get in the way of deals everyone loses. It’s why unions screwed up every industry they involved themselves in and why things cost a fortune. Screw Micah. He won’t take 200 million guaranteed?
